McConnell backs measure to change Senate rules, dismiss impeachment without articles

Senate Majority Leader Mitch McConnell (R-Ky.) is backing a resolution to change the Senate’s rules to allow for lawmakers to dismiss articles of impeachment against President Trump before the House sends them over.

Sen. Josh Hawley (R-Mo.) announced on Thursday that McConnell has signed on as a co-sponsor to the resolution, which he introduced earlier this week.

Spokesmen for McConnell didn't immediately respond to a request for comment about his support.

Changing the rules would either require a two-thirds vote or for Republicans to deploy the "nuclear" option.

The resolution would give the House 25 days to send articles of impeachment over to the Senate. After that, a senator could offer a motion to dismiss "with prejudice for failure by the House of Representatives to prosecute such articles" with a simple majority vote, according to Hawley's proposal.

McConnell has repeatedly lashed out at Speaker Nancy Pelosi (D-Calif.) for delaying sending over the two articles of impeachment.

"This is what they have done: They have initiated one of the most grave and most unsettling processes in our Constitution and then refused to allow a resolution," he said on Thursday.

Add in a Rule to Hold the Speaker of the House in Contempt of the Senate for this charade and you got a deal.

Yeah? I know a 2/3 vote is required to remove the president based on a House Impeachment. But I think a simple 51% majority is all that's needed to vote to dismiss lacking articles.

For all of his occasional lapses, McConnell will never let Pelosi think for a hot second that she'll ever out-maneuver him ... and McConnell has be positively wonderful with the President's judicial nominations and undoing the legacy of the former administration in so many ways. So they’ve got 25 days to invent a bunch of new dirt on POTUS. They will begin doing this forthwith and then make demands for amended Articles. If that effort seems to be going south they will send over the current Articles in 25 days.

Explains why Feinstein was on Pelosi.

Hopefully, a dismissal with prejudice ends up in the Congressional record. Makes it harder for CNN to lie about it 15 years later.

We’re in unknown territory. Some legal experts are saying that the 2/3 vote only applies when the senate officially receives the articles. Until that time they are free to change the rules with 51 votes.

I prefer Grahams plan to try the case without the articles by letting Trump’s lawyers rebut the house case. Then vote to acquit.

It's referring to a 2/3 vote to change the rules, not to dismiss.

But I'm not sure if it's right. I thought a rules change only required a majority vote.

The rule would probably be changed to 25 days from the date the House passes articles of impeachment. So the clock is already ticking.

Senate Rules can be (and are routinely) changed with just a minimum of 51 votes.
