Now that Attorney General William Barr has rightly dismissed the case against Michael Flynn, the Justice Department should review all similar prosecutions and dismiss those that come within the principles that led to the dismissal of the Flynn case.
If these principles were persuasive enough to warrant action in the Flynn case - and I believe they were - they cannot rightfully be limited to one high profile case, without lending support to the accusation, even if false, that politics may have played a role in the Flynn case. The Justice Department must not only be just, it must appear to its citizens to be just. So what are these principles?
The first is that even if some of Flynn's answers to the FBI were not entirely truthful, they were not "material" to any legitimate investigation. It is difficult for some people to understand that lying to the FBI or even to a grand jury is not by itself a crime. The lie must be "material." That is a somewhat technical word that can have several meanings. One such meaning is that if the FBI already had incontrovertible evidence that provided indisputable proof of the answer to the question, then the answer given by the person being questioned - whether true or false - could not be material to the investigation.

I am mystified as to why the Justice Dept. and Flynn’s Defense Counsel haven’t yet petitioned the DC Circuit to remove Judge Sullivan. I have heard a lot of talk about that being a natural course of action, but nothing has happened yet. Why not?
Covington screwed Flynn when they tried to cover up their own mistakes in the foreign agent filing. Plus - any derogatory information they would have about Flynn would be covered by client-attorney.

Try getting the House of Congress to initiate that investigation.

Exactly. It is a conspiracy of ideology and perceived interest. If a leftist has any doubt about what action is required, they need only read the NYTs, Mother Jones, or Vox.
How about the Prosecution of a sitting President being tried for treason,or at the very least being brought before a tribunal of some sort for being caught on an Open microphone telling an enemy,a communist country,that he can be more flexible on Nuclear weapons after his last election.

What the judge is doing delays the process but Flynn isn’t really harmed yet. Wait for the judge to do something tangible that can be appealed such as holding Flynn in contempt, sentencing him on the original plea, etc. Wait for the judge to take substantive action, then there’s enough to appeal.
The game is to try and goad Trump to pardon Flynn.
A pardon implies guilt. Go through this process - even if a pain in the butt - with the ultimate result Flynn is exonerated.
I know all about them. But their relevancy here seems to be in regard to Flynn's guilty plea, which Sullivan is contemplating constitutes perjury. The Covington posse isn't going to say they advised him to plead if he was innocent.
Right, a pardon would undercut Flynn’s credibility once he’s free to speak. The power of his perspective needs to be preserved, not blunted by a pardon.
What options do the Powell/Flynn team have with this new development?
If the sense is that they are continuing to harass Flynn to keep him under the gag order, it there a way that Flynn could rescind that - and SPEAK.
