Report: Cuomo sued for ‘abuse of power’ amid coronavirus pandemic

A Western New York law firm has sued Gov. Andrew Cuomo and state Attorney General Letitia James for alleged “abuse of power” amid the coronavirus pandemic.

HoganWillig PLLC filed a lawsuit this week after the state hit them with a “cease and desist” order for continuing to allow employees to report its office in Getzville, N.Y. The firm said Cuomo’s executive orders shutting down non-essential businesses violated the U.S. Constitution and accused James of resorting to “scare tactics” in threatening civil and criminal penalties.

“Defendants, in a disturbing and gross abuse of their power, have seized the COVID-19 pandemic to expand their authority by unprecedented lengths, without any proper constitutional, statutory or common law basis therefore,” a complaint said Wednesday.

HoganWillig said it was designated as an “essential business” in late March by the New York State Department of Economic Development and allowed to continue conducting essential services in person. Cuomo’s order said lawyers may continue working remotely, but any in-person work will be limited to “work only in support of essential businesses or services."

HoganWillig received a “cease and desist” from AG James’ office for allegedly violating the order in April. The law firm argued James is “standing in the way of individuals who aren’t equipped to participate in video conferences and depositions at home.”

New York state remains under a stay-at-home order through May 28, with non-essential businesses closed. Some regions have been allowed to begin phase one of reopening some industries, but Western New York — where HoganWillig has offices in Buffalo, Getzville and three other cities — has not met all seven criteria for Cuomo’s restart plan.

I’ve been online trying to find somewhere to shop in the areas of NYS that Cuomo has deigned to allow to open. A lot of places haven’t. And curbside/delivery for clothes, shoes just doesn’t work for me. And I won’t buy a TV without seeing it in person first.

Phase 1 is a farce.

From what I can tell Phase 1 is basically what we were already under only with some newly allowable outdoor activities.

Judges are politicized to the point that if this doesn’t get summarily tossed, you know, no standing or merit or some such thing, they’ll politely listen then rule against.

I’m in Ontario county ny. About 100,000 people, about 100 cases. That’s 1/10 of 1 percent of population. About 10 deaths, that’s about 1/100 percent of the population. Meanwhile I can’t get my haircut and my friend’s small business is destroyed.

At least in Delaware, they let the emergency responders get haircuts, including EMTs, Doctors, police, and firefighters, but not much else.

wrongful death lawsuits should probably also be filed based on the orders to put COVID19 patients in nursing homes.

He’s got a good point. Of course, we all know this is Don Vito Cuomolone overcompensating for all the people he killed in nursing homes.

Well, watching Cuomo, it’s *Rules for thee but not for me*.

The guy doesn’t wear a face mask, doesn’t socially distance, and doesn’t look like he’s missed any haircuts himself. He’s carried on about keeping his mom safe and yet throws everyone else’s under the bus and literally murders them with his policies that he later turns around and denies.

He’s got a lot to answer for before God, but I’d like to see some justice here on earth on occasion, too.
