Yes, they should pay out of their own pockets! Isn’t there a duty to law-biding citizen to protect part of the job?

Good. But there needs to be criminal charges against the mayor and governor for giving material support to the rioters. Not CIVIL. Criminal.

An analogy will clear up any doubts. Suppose someone brings a number of monkeys to an art museum and turns them loose. The monkeys are not responsible for the ripped paintings, the broken statues, the stained walls and floors, and the piles and puddles of various excreta. The monkeys did it, but are dumb creatures without any idea of personal property. They have no conscience.

The fool who turned them loose is totally responsible for the actions of the monkeys.

Of course the human rioters are responsible, but the mayor and governor are exonerating them of all responsibility, and guaranteeing they will not be prosecuted. So the mayor and governor have assumed the responsibility.

“It is important to hold our government leaders accountable so this will not happen again”

The only way that will be effective is if government leaders are held personally accountable, viz. by name and financial liability.

A prediction: plaintiff will win or the city will settle, award won’t be anywhere near $3 billion, the city will raise taxes to pay it, and some of the people whose taxes will be raised will be the businesses who were already clobbered by the thing. Because that’s how socialism works.

May he be our next billionaire! Don’t know much about him, but he did lose a son because of gross negligence by that city- that much is clear-

[[No pain and suffering. No punitive damages against governmental agencies.]]

But is the city immune from lawsuits due to gross negligence resulting in death?

I agree.

There has to be some sort of culpability and/or legal standing.

Otherwise it is time to remove them from office forthwith.

We elect them to run and manage the city/state. If they are essentially refusing to do that job...there has to be consequences.

Well notice that this mayhem is resulting in BLM against the government/police and now even here on FR...against the police.

What happens next?

He went in of his own free will.

I look at this in the same way I look at the guy who walked up to lounging lion and slapped it on the rump because he wanted an Action Shot.

He got what he wanted.

So did this young man.

Life is hard and if you are stupid it will kill you.

“Does the city or state have a legal duty to the plaintiff as an individual?”

nope ...

but where Seattle F-ed up is in ACTIVELY AIDING and ABETTING the anarchists by setting up porta-potties, installing protective barriers, and other proactive actions to help and encourage these crminials ... Seattle thereby becomes a partner with the criminals and is a party (a deep-pockets one) to all ensuing damages ...

According to a Supreme Court ruling the police actually have NO DUTY to protect AHEAD OF THE CRIME.

I am sure there are lawyers who can dig the particular cases up.

I believe there are at least 2 cases that say that...one from a man...and one from a woman...

That’s why GUNS matter for all legal society.

I’m praying he wins ...

These democrat cities had their police stand down because democrat mayors were told ‘chaos’ would keep democrats in power and they could blame Trump.

Citizens figured it out - democrat mayors allowed violence. Now that polls and focus groups have shown it’s hurting Biden the violence will stop. That’s a hint... if they can stop it on a dime when it hurts Biden - they could have done that months ago.

If this man and his son lived in a Republican state, Horace Lorenzo Anderson would be alive today. OUR Red State mayors kept their promise to citizens...and kept us safe. Democrat mayors bowed to thugs and commies because they were in on the scam.

Punitive damages. Some defendants consider a compensatory award (~$1M from your apparent perspective) merely the cost of business; takes orders of magnitude more to get across “don’t do that!”
