The over arching principal is that the states pick the President. I would guess that this SC would not intervene in Bush vs Gore. Do we really want every election adjudicate but the FEDERAL judiciary?
On the other hand, I have a nagging suspicion the SC will eventually intervene to had the reigns of power to totalitarian regime on the coming decade or so.
The Progs will take every chance to expand federal power even if it means letting conservatives/ Republicans have it for awhile.
