Rep. Kyle Biedermann floats a referendum on Texas secession

Claiming that the federal government is “out of control and does not represent the values of Texans,” a state representative from the Hill Country wants to give Texans the option to opt out of the union.

State Rep. Kyle Biedermann, R-Fredericksburg, told his supporters on Facebook that he plans to file a bill allowing for a referendum on secession.

"The federal government is out of control and does not represent the values of Texans. That is why I am committing to file legislation this session that will allow a referendum to give Texans a vote for the State of Texas to reassert its status as an independent nation. This legislation perfectly aligns with Article 1 Section 2 of the Texas Constitution which reads: “All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient.” #Texit"

The Republican said the proposal aligns with the Texas Constitution, which states that Texans have the right to reform or abolish their government.

Biedermann did not offer more specifics on the bill, which has yet to be filed, online records show.

Texans have wondered about secession before, but in reality, it’s very unlikely to occur. It would not only be controversial, but potentially illegal.

My understanding is that the federal government cannot compel a state to remain under its control, and Texas’ constitution specifically allows them to secede by just saying the word.

You are right no where in the U.S. Constitution does it say a State has to stay in the Union.

Although the Feds did not like South Carolina trying to back out in 1860.

Mexico as a nation-state wouldn’t invade, but the cartels would make things pretty dicey.

I think pretty much every state except NY (NY city), MA and California (and of course DC) would ultimately agree to go with them.

Texas has it in their Constitution. So they can do it and easily be their own country.

I would expect other States to follow if this happens.

Current Supreme Court precedent, in Texas v. White, holds that the states cannot secede from the union by an act of the state. More recently, Supreme Court Justice Antonin Scalia stated, “If there was any constitutional issue resolved by the Civil War, it is that there is no right to secede.”

Not yet, wait for the leftists from NY and California to finish flooding in first. I’d hate to lose Texas but at least that would give it a silver lining.

Plus a bunch of pissed off rednecks with guns and trucks.

Mexico ain’t anything to worry about, we’ve kicked the shit out of them more than once with less.
