I’m not even sure if I see the point of the lawsuit. Either Pence has the constitutional ability to do what Gohmert says he wants him to do, or he doesn’t.

If he does, then the lawsuit is unnecessary.
If he doesn’t, the lawsuit is also unnecessary.

Agreed. Expected this. The judge found that Gohmert suffered no legally recognizable injury.

The other plaintiffs, a group of Arizona Republicans who self-identify as an alternate “slate” of pro-Trump electors, could not link their supposed injury to Pence, he reasoned.

This case never had a shot at being heard. I really do not know what they were thinking except to show support.

I am of the opinion that it should have been dismissed on the merits. The 12th amendment is clear with regards of the duties of the President of the Senate and it DOES NOT provide such an option to the VP. It clearly states that ALL the certificates must be opened and counted.

That is a procedural role and is designed to allow the legislatures the opportunity to object.

I keep wondering about much of the actions surrounding the stolen election, like this.

Are they just trying to keep eyes and attention on the fraud, not let the election slip down into acceptance?

They need to constantly agitate to keep interest and news?

The very first thing a court will do is try and determine if the plaintiff has standing. They do this before they consider the merit of the case. In Pence's response he explains exactly why the plaintiff does not have standing. The Judge obviously agreed and dismissed the case.

I once tried this lack of standing thing in court once. Since there were no parties that could claim to be victims of my Jay walking on a nearly abandoned street my case had to be dismissed. The judge gave a little lecture about the potential victims involved and ruled against me anyways. ‘Standing’ is just the Judaical equivalent of ‘my dog ate my homework’ excuse as far as I am concerned.

Anyone notice the legal game?

Sue before the election and there’s no standing because it’s premature.

Sue after the election. And there’s no standing because you didn’t sue beforehand.

Take a moment to read Pence's Amicus Curiae response. It explains exactly what is needed to have standing. Its a three part test. Again, if you cannot satisfy all three things the case gets tossed before the merits are ever considered.

I think it is fascinating that almost every case has been tossed for lack of standing. Trump has, at his disposal, some of the brightness legal minds. They all know how it plays out, yet it seems every case gets tossed. At some point you have to ask, is that a strategy?

Exactly. It was a stupid lawsuit. Pence doesn’t have the constitutional authority to do this-it’s not legal. Anyone who has read the law knows it. Pence READS the votes. Period. People saying otherwise look like a bunch of idiots.

5D Trump Chess...this may just be cover for the big game...

The only event that will matter is the potential for Pence to throw out “illegal & unconstitutional” elector ballots on January 6th...

If Pence acts with integrity and a political scenario plays out that Trump wins...then a DIMS emergency lawsuit will be rushed to SCOTUS...no doubt...

In the SCOTUS finale, the rubber may truly meet the road for the survival of the Republic...
