A federal judge on Friday dismissed a bid by Rep. Louie Gohmert (Texas) and other Republicans that sought to endow Vice President Pence with the legal authority to effectively overturn President-elect Joe Biden’s electoral win.
In his ruling, Texas-based U.S. District Judge Jeremy Kernodle, a Trump appointee, said the GOP plaintiffs lacked standing. The judge found that Gohmert suffered no legally recognizable injury.
The other plaintiffs, a group of Arizona Republicans who self-identify as an alternate “slate” of pro-Trump electors, could not link their supposed injury to Pence, he reasoned.

Kernodle (Trump judge) said that Gohmert was claiming an “institutional injury” to the House of Representatives by an argument that would strip the House of its electoral oversight (which will in fact be asserted on January 6) and give all power to the Vice President. This would’ve meant Richard Nixon could have chosen himself President in 1961 or that Walter Mondale could have “re-elected” Jimmy Carter in 1981 all on their own and without Congressional input or interference.
No VP Pence is not part of the coup.

The Vice-President has no authority other than to count the electoral votes on 1-6-21. It is up to members of Congress to carry the day.

When McConnell refused to go into recess for the entire 4 years, preventing recess appointments by his own party’s President, Pence never pressured him to do so.
