Joe Biden is giving companies a second chance at outsourcing American jobs to foreign H-1B visa workers.
The United States Citizenship and Immigration Services (USCIS) announced that the agency will allow companies to reapply for foreign H-1B visa workers who were previously denied such visas when they applied for them over the last four years of former President Trump’s administration.
USCIS rescinded three reforms pertaining to the H-1B visa program, which has been readily used for years by companies to replace Americans in high-paying white-collar jobs. The reforms helped prevent multinational corporations from using Indian outsourcing firms to grab loads of foreign H-1B visa workers to fill U.S. jobs.
Now, eligible companies that were denied H-1B visas under each of the reforms can appeal the denial in the hopes of nabbing foreign visa workers. Lawyers who represented outsourcing firms told Law360 that at least 75 percent of H-1B denials in the last few years were a result of Trump’s reforms.
“Do we really need to invite the HCL, Tatas, and Wipros to reapply for all the H-1Bs that were rejected during the Trump years,” the group White Collar Workers of America wrote in a post online, referencing the Indian outsourcing firms set to benefit from the move.
“All of those H-1Bs were rejected for a reason, to fight outsourcing companies who abuse the H-1B lottery and game the system,” the group continued.
Last month, the Biden administration rescinded a Trump reform that prevented companies from bringing entry-level computer programmers to the U.S. to fill jobs on the H-1B visa, noting that the occupation did not meet the program’s “specialty occupation” requirement.

If you are in IT and are looking for a job in the USA, you are basically totally screwed now. Our own government is destroying us by orchestrating this foreign invasion.

Agencies ceated by congress routinely state they make their rules as agents of Congress. Where are our congresscritters to challenge these agency rules? Where is the law proscribing no imports until unemployment improves to the Trump level of 2% ????

Yep. Indians absolutely own IT and software engineering, and have their recruiters have started targeting take overs of other white-collar fields, like finance, medical and insurance. Hell, hated going to smaller truck stops as most of those are Indian-owned, when I was driving.
I have a Hispanic middle name (but due to the Portuguese? many Indians have Hispanic sounding last name as well)
I don’t list my first name on resumes.
So get many calls and emails for Dalit recruiters. Always ghosted after they determine I’m a US citizen, Hispanic, and not Indian.
Tired using an Anglo form of my name, (first and last only) then I got absolutely no calls or emails.
I’ve blocked so many and send their emails straight to spam and I still get a few calls each day and 10 to 30 emails a day.
Maybe 1 or 2 a week from Americans (mainly CyberCoders)
I use Google Voice for my resume. Prior to Muh Virus, the Google Voice line would ring all day long.
Now, I get one call a month from Apu.
A year ago, my LinkedIn feed was a graveyard of unemployed recruiters. They haven’t returned.
I might get one call per month, direct from an employer.
I have a Desi recruiter e-mail filter I call “useless.”
I don’t send the messages to spam. I use their useless inquiries to figure out who may be hiring.
