High court asked to review men-only draft registration law

WASHINGTON (AP) — The Supreme Court is being asked to decide whether it's sex discrimination for the government to require only men to register for the draft when they turn 18.

The question of whether it's unconstitutional to require men but not women to register could be viewed as one with little practical impact. The last time there was a draft was during the Vietnam War, and the military has been all-volunteer since. But the registration requirement is one of the few remaining places where federal law treats men and women differently, and women's groups are among those arguing that allowing it to stand is harmful.

The justices could say as soon as Monday whether they will hear a case involving the Military Selective Service Act, which requires men to register for the draft.

Ria Tabacco Mar, the director of the American Civil Liberties Union’s Women’s Rights Project, who is urging the court to take up the issue, says requiring men to register imposes a “serious burden on men that's not being imposed on women.”

Men who do not register can lose eligibility for student loans and civil service jobs, and failing to register is also a felony punishable by a fine of up to $250,000 and five years in prison. But Tabacco Mar says the male-only requirement does more than that.

Don't see how SCOTUS can rule otherwise, century old common sense is no longer allowed.

That fat slob congressman from Harlem brought up the idea of reinstating the draft 20 years ago. Got a lot of eyebrows raised amongst the young even though it wouldn’t get anywhere.` If it scares women perhaps it might do some good. We’ve been involved in too many skirmishes that we didn’t have tp.

Not just men only, but ANYONE in the country of age for selective service.

Every illegal standing on our soil of draft age is committing yet a further crime by not registering.

If they are amnestied, this would be yet one more crime they would have to be forgiven...which doesn’t happen for citizens.

So yeah...let’s include the girls. Of whatever stripe. Let Juana of Guadalajara know that she may end up cleaning latrines for Los Gringos in Afghanistan if she barges the border.

Illegals already have to register. There is almost no exemption if you are a male, and 18 to 25.

They always show up when a thread mentioning women and the draft is posted.

Have wondered about this for years. If the radical feminists ever wanted true equality, they should have demanded years ago that the law require women to register for the draft the same as men.

They don’t think that far ahead.

I think getting out of non-voluntary service would be very easy, and disruptive to training and morale.

Yes, but they don’t, and many of them find out that they have to when they get here, but still don’t, because of course a) they’re criminals breaking the law by being here, and b) they don’t want to end up in the big bad gringo army.

You’re right, they don’t think that far ahead.

And of course that means we should prosecute them for that crime as well as Entering Without Inspection (Crime #1) when they are apprehended.

As for being “disruptive to training and morale”, I think battalions of unarmed ditch diggers, latrine cleaners, lawn maintainers and road repair laborers overseen by some of the meaner NCO’s would be quite welcome in the military to relieve the actual Americans from having to do those tasks. Letting them know that might be their fate upon arrival might be just a bit of deterrence: you may get drafted, but you won’t get a weapon and you won’t be doing anything fun.

Semper fi, bro, but it's past time for including women in registering for the draft. There are thousands of positions that women be able to serve in, should mobilization be required.

Has nothing to do with dodging the draft...I did 8 years on active duty (76-84, Army - Air Defense Artillery), my last job was a HQs Battery Commander, basically CG's staff and other directorates at Fort Bliss, i.e. cooks and clerks.

Cooks and clerks will be needed in the next war, too.

I'll be ready, too, putting one of these in my backyard:

I'm more than qualified, lol: was a platoon leader for both Chaparral platoons, in our composite Chaparral/Vulcan, took both through their Tac Evals, as well as one of the Vulcan platoons. Few jobs in the Army are more enjoyable than that of a platoon leader.

Equal rights = equal responsibilities. They do it in Israel. No problem as far as I’ve heard.

Amen, citizens should not be plucked against their will by a despotic government to fight wars, especially non-declared wars/vague definitions of what exactly victory entails, half way across the country with no intention of quickly ending.
We are freemen, not cogs for a Congress and Executive Branch to meddle with.
If directly attacked, you won’t need a draft to figure out proper action.

There was a time when joining the military after school for two years was an honor and duty young men simply did for their ‘service’ to the country. It wasn’t a matter if you joined or not rather which branch of the service did one select.

The old catch-all of “failure to adapt to military life” lets some off the hook, if they could brazen it out. Without corporal punishment, that’s a possibility. I’m not sure what kind of disincentives you could tack on. We had a guy recycled into our squadron that just decided he wasn’t going to do anything but sit and bitch. And he did.

Not sure what kind of discharge that would get you. Many would take a bad discharge over punitive service. And you won’t be digging ditches if you’re pregnant.

The logic behind protecting women from being forced into military service today was rejected by the choice to allow them to volunteer for it yesterday. How many episodes of the Captain Obvious skit are we up to by now?
