Judges Block Business Plan to Import More White-Collar Workers

Three judges have rejected a sneak claim by business groups to double the inflow of foreign visa-worker graduates into the jobs needed by American college graduates.

“This is a terrible decision for the [visa worker] community,” lamented a June 9 tweet by Cyrus Mehta, a New York-based immigration lawyer.

“The DC Circuit just killed the hopes of not counting dependents against the green card cap,” mourned David Bier, a migration advocate at the business-funded Cato Institute.

“What that does is it lowers the supply of [foreign] workers coming in,” Kevin Lynn, founder of U.S. Tech Workers, told Breitbart News July 12. “That’s a benefit to have the American workers who are grappling with job insecurity, offshoring, and outsourcing of their jobs,” he said.

The lawsuit had asked the judges to force the government to supply free green cards to the dependent families of workers who get “Employment-Based” (EB) green cards from their employers. The lawsuit was intended to help restart the clogged sale of EB-5 green cards to wealthy Chinese investors. But if the court claim had been approved, the judges would have effectively doubled the number of EB green cards that employers could offer foreign recruits, up from roughly 140,000 each year to roughly 280,000.

In turn, the expanded number of green cards would double the inflow of foreign graduates eager to take U.S. jobs for low wages in the hope of also getting the huge prize of green cards. The cards allow the foreign workers to migrate from their poor and chaotic home countries.

The court’s decision is good news for U.S. graduates because it crimps the ability of U.S. companies to discriminate against them in favor of foreign workers for many career-starting white-collar jobs. [...]

We need to get jobs for AMERICANS, not cut a livelihood out from under them and give those jobs to FOREIGNERS.

Cyrus Mehta (an Indian, of course) needs some MS13 parolees to be quartered at his house.

Our federal government should be protecting its citizens.

All H1b visas should cost $25K per employee and pay at least 50% over prevailing wages. Then, we will truly see if there is a labor shortage or if business are trying to push down labor costs with foreign nationals.

The level of presumption in Indian workers (who work harder but NEVER smarter) re: jobs in the USA is breathtaking.

And other than subsistence here they send all their $ back to India where they buy property and make arrangements to eventually live like Rajas in 10 years or so.

They are an artificial drain on the economy.

Yes, let us be bitches to China and controlled by importing India visas so they can impose nepotism within the business COC. Our country has enough able workers and materials to be isolationists, be secure, and embrace the free market all at the same time ON OUR OWN ECONOMIC AND MILITERISTIC TERMS

Adam Smith is not the end all be all because of various factors that were not present in his day...nuclear weaponry for one, ingrained Marxists theory is another embraced by idiots who are free trade or bust regardless of the ramifications countries that practice that evil. My daughter graduated from a coding boot camp through the University of Arizona in February 2020. Then Covid hit and hiring stopped. She’s been applying for coding jobs for almost a year now and still hasn’t found one. We don’t need to import foreign workers when American citizens are qualified to do the job, FFS!

Foriegn IT workers studied and learned IT!
U.S. IT graduates are much more likely steeped in ‘wokeness’, maybe? And may be a major distraction to an entity pursuing IT
Dominance... or, at least. Excellence?
