Ashli Babbitt, a California woman who participated in the U.S. Capitol riot on Jan.6, was "ambushed" by the Capitol Police officer who fatally shot her as she tried to enter the Speaker’s Lobby outside the House Chamber, a lawyer for the family said this week, according to reports.
The family plans to file a $10 million wrongful death lawsuit against the Capitol Police and the officer, the Washington Examiner reported.
Terry Roberts, a lawyer hired by Babbitt’s family who specializes in police misconduct cases, told Real Clear Investigations this week that he believes the officer didn’t give Babbitt verbal warnings before he fired.
"It’s not debatable. There was no warning," Roberts alleged. "I would call what he did an ambush. I don’t think he’s a good officer. I think he’s reckless."
The unidentified officer’s lawyer, Mark Schamel, has denied Roberts’ version of events.
"It’s a false narrative that he issued no verbal commands or warnings. He was screaming, 'Stay back! Stay back! Don’t come in here!'" he told Real Clear Investigations.
He said the officer’s warnings couldn’t be heard on cell phone video of the shooting because he was wearing a mask and the video was from the other side of the doors in a loud room.
"Lethal force is appropriate if the situation puts you or others in fear of imminent bodily harm," he continued. "There should be a training video on how he handled that situation. What he did was unbelievable heroism," according to the Examiner.

So shouldn’t they have to name the officer during the trial. Or I guess it will never make it that far. There was 2 officers standing there with riffles that could have pulled her from the window but just watched. Same with the shooter. Could have taken 2 steps and pushed her back through.
“They” had to have violence and death and he provided it. I hope he does not commit Pelocicide before he is questioned and investigated. To much knowledge today is very unhealthy.

There was a capitol police officer who said he saw ANOTHER security office say “I’m gonna get me one” (he took it to mean killing a protester)
Find that guy and make him say who it was.

Say her name! There is no uniting with these people. There is no “law” with these people. At some point, we will have to separate them; the only question is whether that happens before or after a good bit of violence (that has already started).

What trial? The shooting was ruled to be justified by the DOJ and Capitol Police so there will be no criminal charges to try. And the officer in question can't be sued because like all police officers he enjoys limited immunity. Babbitt's family can sue the Capitol Police but the identity of the shooter may not be relevant to that suit.

True. But there has been case after case over the last couple of years where officers could have done something other than shoot an unarmed suspect but instead killed them and were never charged. Babbitt's case is just another instance.

It truly was and is unbelievable.
That is indeed a possibility. Someone wanted to talk and got “Epsteined”.
It is not possible to trust news reports when they lie so blatantly and continuously like this.
Also, how convenient that the lawyer for the cop says he did warn Ashli, but he could not be heard due to the mask and the doors. She would have heard him because she was standing in the window opening just feet from him. Because the glass was broken out, others should have heard him too, including the cops standing right behind Ashli. And masks don't prevent people from hearing someone supposedly shouting. Heck, masks don't prevent people from hearing others in normal conversations.
It looked like a hit to me.
