A second federal judge in Washington questioned whether the lead felony charge leveled by the government against Capitol riot defendants is unconstitutionally vague, as 18 Oath Keepers accused in a conspiracy case urged the court on Wednesday to toss out a count carrying one of the heaviest penalties against them.
U.S. District Judge Amit P. Mehta asked how federal prosecutors distinguish felony conduct qualifying as “obstructing an official proceeding” of Congress — punishable by up to 20 years in prison — from misdemeanor offenses the government has charged others with, such as shouting to interrupt a congressional hearing.

He was arraigned and released on bail, charged with a misdemeanor and walked. He was a central figure in the staging. Then there was the Prouds Boys leader who was in fact an FBI informant/operative, who was pulled off the streets the day before on the 5th, after attempting to induce and insurrection, which failed. The FBI staging unit had a lot bigger plans that failed, and all we had is a slight Whizmo from a small miniority of partying Republicans who were let in by the Washington Police on the Senate Side.They were INVITED in.

Here’s as easy one. The window frame that Ashli entered — how was it cleared?
Another easy one. How many signals precipitated Ashli’s entrance to the frame?
Less obvious. When the gunman’s muzzle flashed, what was the angle of the barrel?
More complex. What was the distance between the gun and Ashli?
Would you really expect a trained AF Vet to knowingly jump into a gunman’s line of fire?
A question for you: What’s the basis of your conviction?

And this is my biggest problem with so many arguments from the right: there are layers upon layers of facts that INSINUATE this, and INSINUATE that, and — OMG! — INSINUATE this other over here; as if all that’s necessary to PROVE something is to stack up enough INSINUATION.
Just — no.
It’s NOT the case. It NEVER will be.
The rules of EVIDENCE admit to a preponderance of circumstantial facts, but those facts aren’t mere insinuations; they’re a LINKED SET of ESTABLISHED TRUTHS that point to an inescapable conclusion.
There’s people can’t even agree that Ashli’s dead; how can they agree she’s been cremated? Fahrenheit 451?
