Ed Dept Opening Civil Rights Inquiry Into Florida Governor's Ban on Mask Mandates

The Department of Education said it has opened a civil rights investigation into whether Florida Gov. Ron DeSantis is violating the rights of disabled students with his executive order banning mask mandates. On Friday, the Department of Education’s Office for Civil Rights issued a letter to state Education Commissioner Richard Corcoran. The document said th DOJ was ''opening a directed investigation'' into whether the statewide ban on mask requirements in schools ''may be preventing school districts in the state from considering or meeting the needs of students with disabilities.'' The letter, from Suzanne Goldberg, the Education Department’s acting assistant secretary for civil rights, went on to say, ''OCR’s investigation will focus on whether, in light of this policy, students with disabilities who are at heightened risk for severe illness from COVID-19 are prevented from safely returning to in-person education, in violation of Federal law." Said Goldberg, the inquiry will consider if Florida is "preventing schools from making individualized assessments about mask use so that students with disabilities can attend school and participate in school activities in person," as is their right. The DOJ action came on the same day that the First District Court of Appeals reinstated the governor's ban on school mask mandates. It had been blocked by a circuit judge. DeSantis has maintained his ban exists because the decision on whether children mask up in classrooms belongs to their parents and guardians.

So a ban on a government mandate violates the civil rights of the disabled? How is it that giving power to parents to make the decision for their child's wellbeing is a violation of the civil rights of disabled children?

Do they even think?

Again, he is banning just mandates. Folks can still wear masks if they choose.

Will federal agents show up Florida and other states with arrest warrants for governors?

Disabled children can wear masks. They just can’t be FORCED to wear masks.

Florida’s law means the government cannot FORCE you.

How the HELL is that discriminatory?

The best way to protect children in school likely to be susceptible to Covid is to open up all the windows and place them near the windows where air is coming in.

Note the spread of Federal power in the multitude of "Civil Rights" offices? The DoJ has the oldest and largest but it appears that almost every Cabinet Branch has their own! Of course the Department of Education - Office of Civil Rights is already INFAMOUS for the 2011 "Dear Colleague Letter" from OFFICE OF THE ASSISTANT SECRETARY [un-signed] that opened the door to universities & colleges doing 'star court' procedures against male students in improper sex cases.

Some of us may remember what is contained in that 'trigger warning' Declaration of Independence, pertaining to the grievances against George III; "He has erected a multitude of New Offices, and sent hither swarms of Officers to harrass our people, and eat out their substance."

Building on what you have posted: the best way to protect children in school is to keep them out of public schools.

Only in the most extreme circumstances should parents allow their child to be in government schools.

IF there is an issue with a disabled student-—I think the kid CAN wear a mask.

DeSantis is against MANDATES for ALL the kids.
