One could argue self defense, but it doesn’t look good.

They tried. But in Georgia, as in I think every other state, if you initiate the incident and things go wrong and you kill someone then you can't claim self defense. The McMichael's started it so they're responsible for anything that happened.

Regarding the citizen’s arrest statute, there is immediate knowledge “or” prior suspicion, but the state and the court have told the jury it’s both (”and”).

The guys in the truck confronted the guy they were chasing (Ahmaud Arbery) and while fighting over the shotgun, it discharged, killing Arbery.

Who was fighting over the shotgun: the guys in the truck or the guy they were chasing?

I think in Wisconsin, as long as you retreat you can instigate the event and still claim self defense. The argument being, by retreating you have now made an attempt to deescalate and get away from the situation and the person chasing has now become the aggressor.

I stand corrected. You accurately describe the statute, and the court’s instructions do not appear to reflect what the law actually says.

Serves me right to take the Judge’s word for it.

Here’s the statute:

“O.C.G.A. 17-4-60 – “A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.”

“reasonable and probable grounds of suspicion”, which would take in the totality of the circumstances. That’s not what was in the jury instructions we heard on the news this morning.

According to reports I’ve heard, they did call the cops. Over and over and over. They would come, the bad guy would be gone, they would move on. The neighborhood had gone from completely safe to parents not letting kids out of their sight, having to worry about putting everything away so it wouldn’t get stolen, etc. What would you do?

Ummm put my hands up and surrender. They said he was under arrest. He resisted and tried to grab the barrel of the gun. Wanna guess how that would have turned out? Who the hell grabs the barrel of a shotgun anyways?

You and I are in the minority on this subject. I guess most people are willing to let criminals run rampant in their neighborhoods when the police can’t or won’t stop them. Sad.

Arbery and the younger McMichael. This was after the elder McMichael in the truck had told Arbery to stop or he would blow his head off. Not unreasonable to assume Arbery feared for his life so he fought for the gun.
