A federal judge has allowed a Disneyland passholder lawsuit to move forward that claims the Anaheim theme park misled and deceived its most loyal fans by artificially limiting capacity and restricting reservations, according to court documents.
The complaint filed by Disneyland Magic Key annual passholder Jenale Nielsen of Santa Clara County has been working its way through the court process since November 2021.

The lawsuit alleges that Nielsen purchased a $1,399 Disneyland Dream Key annual pass with no blockout dates in September 2021, but was unable to make theme park reservations for certain dates in November 2021.

Disney has taken the position that Disneyland has the power to artificially limit theme park reservations and decide when to make Dream Key passholder reservations available or unavailable, according to the response from Nielsen’s attorneys.
“Disney appears to be limiting the number of reservations available to Dream Key pass holders on any given day in order to maximize the number of single day and other passes that Disney can sell,” according to the response from Nielsen’s attorneys. “This practice directly contradicts Disney’s advertised promise that the Dream Key would not be subject to blockout dates.”

Disneyland sold out of the top-priced Dream Key in October 2021 amid howls from angry passholders due to the widespread lack of reservations available for the $1,399 pass with no blockout dates. The $949 Believe Key sold out in November 2021. The $649 Enchant Key and $399 Imagine Key remain available.
Magic Key reservations were frequently unavailable when the new annual pass program first launched while the daily ticket calendar often showed widespread availability.

I don’t know why anyone would buy such a thing, but if you fork over almost $1400 to be able to go to Disney any day, you better be able to go to Disney any day, or what’s the point?

Sounds like a scam. Not that I haven’t seen these things before. Disney has a reputation for having good lawyers but if I was on a jury seeing a bait and switch, I’d not be moved by their quibbling over fine details.

True, but it’s really worse. They have parks/rides with absolutely finite capacity and routinely are way over that capacity. In the 1990s, they managed the load through long lines that had stated wait times; then introduced the “fast pass” which only increased the wait times of those who didn’t have it; then they had something else that was to grant you several of the “big” rides provided you showed up at the right time.
They are deceptive and misleading; but honestly I don’t know what they can possibly do to handle capacity. Disneyland especially is a small park, even with the (Pay extra) Kollyfornia Adventure. FL parks are spread out, and there are four of them, so it’s a little easier.
We were in Disneyland just before the China Virus. Got on every ride we wanted, usually no more than an hour wait (Matterhorn, Space Mountain). Rides that constantly moved, like Haunted Mansion usually had wait times of 20-30 minutes. Matterhorn has some of the lowest capacity, despite two tracks, because I think each bobsled only holds 6, although they may have expanded them to hold a few more. I think Space Mountain ships hold 12-16. They took out the sub ride because among other things it was absolutely the lowest capacity ride and the slowest to load.
I’ve been going to Disneyland once a year for the past quarter century. The fine print of all their tickets and programs always discloses Disneyland can do basically whatever they want. It’s buyer beware.
Yes, I’m in favor of Disneyland now requiring reservations (as airlines do and as sometimes museums do).
Social media resulted in locals in Disneyland telling everyone stuff like: “Hey, they introduced a new pretzel today” and suddenly thousands of unexpected local visitors would swamp the park. Remember Disneyland is surrounded by MILLIONS of people in LA.
Disneyland couldn’t plan for staffing etc and so the reservation system helps them with that. Time will tell if it helps with the crowds. Apparently not—it’s as crowded as ever but perhaps more evenly disbursed over time. And it makes sense for them to charge more during peak times too.
I’m ok with that, but I think it will take more. And it can’t be done by just hiking prices so far only the uberwealthy will be able to go. I’m not sure what the solution is. Maybe extended hours.
