LAS VEGAS, Nev. (FOX5) - A Henderson resident believes his freedom of speech is being violated over a bumper sticker on his truck.
A bumper sticker that reads “Let’s Go Brandon” is causing all the trouble for the man who is being told by his homeowner’s association that displaying the sticker on his truck is considered an offensive trader activity.
Chris lives in the Central Park Estates neighborhood located on the cross streets of Bermuda and Pebble. You can often see his red truck parked in his driveway usually with flags attached to it, but not anymore.
“They said I had to take it down because it was a sign or a billboard,” said Chris.
The HOA allows residents to have one political sign in the front yard during voting time. But since Chris left the flag on his truck after voting time was over, he was asked to take them down or else the HOA’s lawyer was going to take him to court.
“It makes me feel upset,’ said Chris. “I am a veteran. I did take an oath to this country. I believe freedom of speech should be everywhere.”
Chris resorted to implementing a bumper sticker that says “Let’s Go Brandon” on his truck, but was told this also isn’t allowed. The phrase has become an anti-Joe Biden phrase used by conservatives.

HOAs that restrict actual speech should be unconstitutional.
I just visited my brother and commented about how many Let’s Go Brandon flags I saw around there.
He and his wife figured Brandon was a local high school football player. I clued them in.

As I’ve stated on another site…..Every liberal needs to be herded into the coastal hives they’ve created in California, Washington, Oregon, along the East coast, a few big cities.
When they’re all in those places, each is walled off and protected by guys with guns.
Commerce can be conducted for food and anything else they need, but they cannot leave. EVER. Unless they’re a good looking women who is sick of the skinny jean wearing, pajama boys and decides they want a guy that knows the difference between a hammer and an apple. But it’s treated like a mail-order bride or something.

To test the theory he should place a Biden sticker over the Trump sticker and see if they fine him again.

Seems like a step too far for an HOA
No, he should stand and fight, break the HOA for violating his constitutional right of free speech.
Most HOAs are given the authority by state law to do various things, including levying fines for non-compliance, with the stated goal of enhancing the values of all homes within their jurisdiction, enhancing safety, etc. However, just like the state government that gives them that authority, they are beholden to the constitution. The fact that the HOA is not literally a government is meaningless - it is still found by all of the restrictions that are in the constitution against any level of government. Thus, restricting free speech such as the display of a political bumper sticker is prohibited. I would love this guy to be fined, refused to pay the fine, be taken to court and then appeal to federal court on 1st Amendment grounds. I despise HOAs (well, really the generally power-hungry people running them, just like most of our politicians), and they need to be slapped down on a nationwide basis. This case is tailor-made made for just that result.
Change it to a NASCAR sticker if the HOA’s
complaint is about it being political.

When I was looking for a new home last year I noticed that the homes in the area fell into four general categories:
1. Detached homes with an HOA -- mostly newer subdivisions
2. Detached homes with no HOA -- mainly older suburbs or rural areas
3. Townhome development with HOA -- mostly located in newer suburban area
4. Townhome development with no HOA -- mostly outlying subdivisions surrounded by rural areas
Every one of these had its advantages and disadvantages, but I can tell you that #4 was the absolute worst. These developments tended to look worn and shabby even if they were only a few years old. And many of them seem to have at least 25% more cars parked around them than there are spaces for them in garages and driveways. I decided that living with limited rules and regulations is great, but it is awful when you live that way in a place where you have no space between your home and your neighbor's home.
After lots of research, I found that #1 is the ideal situation if you need to live in an area where residential lots are less than a half-acre in size -- provided the HOA is a "benign" one. And by "benign" I mean it has almost no function other than to enforce rules and regulations and collect nominal fees for very limited common expenses. I found a perfect HOA that doesn't have any recreational facilities and doesn't even maintain the streets or collect garbage. It charges an annual fee of about $100 per home just to pay for the maintenance of an adjacent open space that is used for stormwater management and flood control.
Or a bumper sticker that promotes faggot’s rights.

I have a friend who is a lawyer that specializes in condo/HOA association law. He tells me these things come up all the time with the HOA boards he represents. He always advises them to enforce these laws mercilessly -- even for seemingly harmless signs and displays.
As he told me about a recent case in a nearby HOA: "If you don't force a homeowner to take down his Alabama Crimson Tide flag today, you will not have the authority to force his neighbor to take down his Nazi flag tomorrow."
