How a conservative bloc, unrestrained by public opinion, is leading the U.S. Supreme Court

In front of the steps of the U.S. Supreme Court — nearly a week after the landmark overturning of Roe v. Wade — the president of the National Organization of Women handed out pro-choice placards and pledged to keep fighting for abortion rights.

Christian Nunes also had some strong words about the top court, calling it "compromised" and out of step with public opinion.

"They're not ruling in favour of the people. They're ruling in their own moral viewpoints," Nunes said.

That the recent decisions by the conservative majority court may not be in tune with average Americans is backed up by recent polling and surveys. But those rulings also signal a newly unapologetic and muscular court, willing to buck the national mood.

"They're using their conservatism in a powerful way and they're acting like they're in a hurry," said Stephen Wermiel, a constitutional law professor at American University Washington College of Law.

"For a long time, we've been looking at a conservative tugboat. And now we're looking at a conservative runaway freight train."

Right?

The media doing its thing once again. Public opinion shouldn’t matter to any court, ever. Nor should politics. The law matters.

The only block that is ruling against the majority opinion is the Left.

“They’re ruling in their own moral viewpoints,” Nunes said.”

No, they’re ruling based on what the Constitution actually says.

Stupid slitch.

So, if “public opinion” wanted to reestablish slavery, would this mean that the court should support it?

Or if “public opinion” decided that pi has to equal 3.0, should the court support it?

“unrestrained by public opinion”

In other words, they are doing their job. They are supposed to uphold the constitution. They are not supposed to pay attention to public opinion.

These accusations sounds a lot like what the Left has been doing and want to do.

Supreme Court Justices are placed on the court by the elected President and with the advice and consent of the majority of the Senate. If Harry Reid had not killed the filibuster, it would have ensured that public opinion (through their elected representatives) was more robustly represented.
Liberals are idiots!

Such completely fake news. These people don’t even hide their marxism anymore. I just saw a poll yesterday showing more people supported overturn of Roe v. Wade than disagreed with overturning. Yet here with are with a MSM hit piece claiming we have a rogue court out of touch with public opinion.

Did we ever get any news pieces about the extreme left-wing 60s SCOTUS being out of touch with public opinion? No, of course not. They were to be cast as intellectual heavy weights - the moral “conscience” of the nation. All Justices beyond question, and of absolute, unassailable moral fiber. You don’t question the liberal Justices. You admire them. Got it?

From a 2019 news article --

LAST NOVEMBER, President Trump, irate at a federal district court ruling contrary to his administration’s attempt to stop some migrants from seeking asylum at the border, blasted the judge, Jon S. Tigar, as a biased “Obama judge.” Standing up for the integrity of the federal judiciary, of which he is the titular head, Chief Justice John G. Roberts Jr. issued an extraordinary statement contradicting Mr. Trump, albeit without naming him. “We do not have Obama judges or Trump judges, Bush judges or Clinton judges,” Mr. Roberts said . “What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.”

They're not ruling in favour of the people. They're ruling in their own moral viewpoints," Nunes said.

OMG. They're ruling that the peoples elected representative are the ones who have the power to make decisions NOT THE COURT. Their rulings are mandating that the SCOTUS' view should IS the view of the people.

Let’s get rid of the Supreme Court and instead we’ll decide important Constitutional issues by conducting man on the street polls. Maybe 1 out of a 1000 of those people has actually read the Constitution and Bill of Rights, what possibly could go wrong ???? LOL

RE: How a conservative bloc, unrestrained by public opinion, is leading the U.S. Supreme Court

Just my opinion here, but it sure seems to me when the Supreme Court is restrained by public opinion, you get opinions like, Dred Scott or Plessy v. Ferguson or Roe v Wade.
I was taught the Supreme Court was where it was the Constitution that mattered, not public opinion.

The Left wing of the SCOTUS is intellectually weak. Replacing Breyer with a lightweight doesn’t help them. Alito and Thomas are the brains on the Right. The other 7 justices are drooling idiots in comparison. Roberts is the de facto leader of the Left.

A Supreme Courts job is to correctly apply the law. To the extent they do anything else they might as well be the only branch of government because they can overrule anything. That is why courts should never “legislate from the bench”. The court unfortunately often has legislated from the bench in the past...and now they seem to be correcting some of those rulings and actually following the law again. This is a good thing and long overdue.
