BREAKING: Federal Judge Blocks Biden Administration’s Move to Allow Males to Compete in Women’s Sports

A federal judge has blocked the Biden administration’s recent rules giving "transgender" people extended rights in schools and the workplace, including forcing schools to accept biological males into female sports competitions.

The judge acted because Biden’s regulators illegally bypassed a critical requirement of federal law that must be satisfied before issuing such a regulation: giving the public notice of the regulation, time to file comments, and forcing the agency to respond to those comments - a lengthy process.

U.S. District Judge Charles Atchley Jr. agreed with 20 state attorneys general that the regulations may infringe on states’ rights and could be seen as having been improperly drawn.

Atchley blocked the implementation of the rules until a lawsuit addressing the changes could be resolved, the Associated Press reported.

“The APA sets different procedural requirements for ‘legislative rules’ and ‘interpretive rules’: the former must be promulgated pursuant to notice-and-comment rulemaking; the latter need not,” the judge wrote.

“If an agency attempts to issue a legislative rule without abiding by the APA’s procedural requirements, the rule is invalid.”

Perhaps we should use some other way to quality for competition.

I propose a “potential birthing person” group and a “non-birthing person” group.

Seems fair, no?

FR: Never Accept the Premise of Your Opponent’s Argument

It's astounding that the so-called "critical requirement of federal law" doesn't include making sure the laws is reasonably based on one of the specific, constitutionally enumerated powers given to the feds by the states.

"From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]." —United States v. Butler, 1936.

In fact, patriots are reminded that the only sex-related protection that the states have amended the Constitution to expressly protect limits the fed's power for dealing with such discrimination to voting rights issues, evidenced by the 19th Amendment.

"19th Amendment:
The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of sex.

Congress shall have power to enforce this article by appropriate legislation."

Also, Trump's red tsunami of patriot supporters are reminded that they must vote twice this election year. Your first vote is to primary career RINO incumbents in federal and state governments. Your second vote is to replace outgoing Democrats and RINOs with Trump-endorsed patriot candidates.
