Wait, Can They Do That? McCarthy Says House Might ‘Expunge’ Impeachments of Trump

It’s clear now that both impeachments of Donald Trump were shabby partisan affairs that will be remembered as shameful episodes in American history. But they happened, and that’s that — or is it? Now House Speaker Kevin McCarthy has suggested that the impeachments could be “expunged.” Mediaite reported Friday that McCarthy “said at his first official presser in the job that he and the House GOP majority might ‘look at’ the idea of expunging ex-president Donald Trump’s impeachments.”

If this could actually be done, it would be a matter of simple justice. The first impeachment was over a phone call Trump had with Volodymyr Zelensky in which he spoke about Biden’s shady dealings in Ukraine; Democrats trumpeted this as an illicit “quid pro quo” while doing their best to get you to forget that Biden’s Ukraine connections are indeed questionable, and that their current pretend president has engaged in behavior that was quite similar to what they falsely accused Trump of doing. The second impeachment hinged on the bogus Jan. 6 “insurrection,” in which Trump is supposed to have tried to overthrow the government by sending a guy wearing face paint and Viking horns into the Capitol.

well, it should be expunged being it was the absolute stupidist reason to impeach. OTOH, the timing is suspicious in that it changes the narrative over the weekend from Biden docs back to Trump. At the least McCarthy could have waited until Monday or Tuesday so the Biden docs could simmer a while

The expungement of Trump’s impeachments should be done in a deliberate, well-considered manner that is grounded in both the particulars as to Trump AND as a rejection of the summary, contrived process that the Democratic House adopted as to Trump. In effect, the GOP House should articulate a standard for impeachment and solicit Democratic buy-in. The result would be to make any impeachment of Biden and later Presidents harder and more deliberate, with the expungement of Trump’s impeachments then following logically from that premise.

I think the new congress should institute a offensive committee... As in this committees job is to blow the heads off liberal thinkers (as much as they actually can think) as our “Look Squirrel” group. Would allow big things. Idiots in a froth are brain-lesser than normal dumb.

I pray to God that he is waiting on strategic timing when they have something big to pass that the massive kerfuffle will allow to pass which will help us..... What do I know.... I am a mote on a flea on a rats ass.

I'll take the contrary position and ask how an impeachment can be expunged after the trial has already happened?

What is the judicial parallel? Can a person's indictment be expunged after a trial finds him not guilty? That would result in the existence of a trial without a predicate indictment of charges. Is that allowed in our legal system?

I can possibly see it in the situation where a trial is dismissed by the judge for lack of evidence, and then the person moves to have the indictment expunged, but not after a full trial and finding of not guilty.

If an indictment is expunged after a trial finding of not guilty, can the person be charged again? How would double-jeopardy apply in the case where there is a trial but no underlying charges?

Back to impeachment, if an impeachment is expunged after a trial in the Senate, can the person be impeached again as if the first impeachment never happened? What about the prior trial on the now non-existent impeachment?

I don't think this would be found to be Constitutional if it were brought to the Supreme Court. There are just too many unresolved questions to think that the Framers intended an act like this to happen.

I believe he is waiting. Right now, the public focus is on Biden and the Top-Secret stuff. If he expunges now, media shift would be on that 24/7, IMHO.

More than anything I want to see a massive investigation into the coup attempt that used the Russia collusion hoax. What was the FBI, James Comeys role in the coup attempt? When did Pelosi, Schiff, Schumer etc etc know Russia collusion was a hoax and why did they continue? Why did they allow Robert Mueller to hold a fake investigation when they knew it was a hoax? When is Hillary being held accountable?

Excellent summary.

Consider the contrived process as obstructionism. Obstructionism is willful fraud, waste, and abuse of tax dollars, which I consider treasonous grand larceny.
