What Laws Empower Biden and AOC to Ban Fracking?

As you kind people know, I have been writing about the moronic ban on fracking that Mr. Biden promised to impose on our nation almost the moment he was inaugurated. This measure would have cut domestic oil and gas production by more than 35 percent since early 2021. It has caused oil and gas prices to skyrocket as oil and gas became in short supply. We would have to beg countries that hate us for oil. We are already draining our strategic petroleum reserve — a life/or/death military asset — at an alarming rate.

As it happened, Mr. Biden “walked back” this deadly promise. He did ban fracking and even drilling on large swaths of federally owned land. But it was not even remotely on the scale that Mr. Biden promised. It did lessen hydrocarbon production from those areas and as we all know, prices at the pump and in the furnace have risen dramatically.

They would have risen far more had Mr. Biden not eaten into our vital strategic petroleum reserve. I hate to think what will happen if we and our allies need that oil in wartime.

Again, Mr. Biden did not go anywhere near as far as he promised, thank God.

But I keep asking myself, “Where did Mr. Biden think he got the authority to stop fracking? What law authorizes the President to control hydrocarbon production in the U.S.?”

The oil companies don’t resist because the price increases and they don’t need more capital investment to get it every time Fedzilla restricts supply. Look at Exxon’s and Chevron’s profits.

There isn’t one

Just like there’s no law that allowed Soetero’s DACA, admitted by even him.

No law that actually allows the AHA.

No law that allows for birthright citizenship as its currently being abused and has been abused for decades.

Yet here we are.

And that statement demolishes the commonly-believed conspiracy theory that oil companies just raise prices for no reason so they can gouge everyone. If that were true, prices would never go down. But of course they fluctuate wildly in both directions in response to market forces and in this case, idiotic political actions.

We live in the age of the Imperial Presidency. Presidents (D and R) essentially rule by decree. But they are not absolute monarchs, not just yet. They are usually careful to find some resolution or regulation to give them cover.

A prime example of that is George W. Bush’s invasion of Iraq. He started a major war all on his own. He didn’t bother to ask Congress for a formal declaration of war, as is required by the Constitution.

Oh, but there was a resolution that gave Bush cover. So I guess it’s all good. Just as I’m sure there’s some regulation somewhere that can be twisted to give Biden the “right” to set the nation’s energy policy all on his own.

You know it’s a shame. Our founders wrote a pretty darn good Constitution. That document gave a list of things that the government is permitted to do, and it was intended that this list be exhaustive — if it’s not on the list you can’t do it. They even added the Tenth Amendment to cover cases where something isn’t on the list — such powers are reserved to the states or the people.

Banning the extraction of natural gas (or any other natural resource) is not on the list of enumerated powers. We should really get back to using our Constitution; it’s been a good century or so since anyone has done so.

It is as if the overnment and the Industry are acting together in restraint of trade. Isn’t there something about that somewhere in free trade laws and monopoly laws?

The problem is SCOTUS. They move at glacial speed, and before they can even act, the damage is done. They make everything more complicated than need be. The Constitution is written in plain English, but you'd think they were spending months and months interpreting ancient Sanskrit.

The Authorization of Use of Military Force against Iraq as all but a declaration of war. Which HRC voted for, I will point out.
