An Arizona rancher has been charged with first-degree murder and had his bail set at a whopping $1million for fatally shooting a Mexican citizen on his property.

George Alan Kelly, 73, was arrested following the January 30 fatal shooting of Gabriel Cuen-Butimea, 48, on his ranch in Kino Springs, just a mile and a half north of the US-Mexico border.

Authorities are still investigating the fatal shooting, with the Santa Cruz County Sheriff's chief deputy saying it does not appear that Kelly knew Cuen-Butimea ahead of the shooting.

here is the listed legal description:

Trespass is generally when a person knowingly enters or remains on a piece of property after they have been requested to leave.

That's a damned good law and it should be enforced precisely. Arizona has a good reputation regarding conceal carry, open carry etc., at least as I remember. Frontier carryover...

It's noteworthy that the article doesn't mention the judge's name, although that is public information.

Looks like Emilio G. Velasquez is the judge, and Kimberley Hunley is the prosecuting attorney.

This incident took place in Arizona. And, according to the article deadly force is allowed to protect property in Arizona. If this is in fact the case then, the judge must be aware of this and incarcerated the old man with a ridiculous bail amount knowing that his action was lawful in the state.
Once the old man is released and acquitted in accordance with state law he should sue for unlawful imprisonment, pain, anguish, etc...

We don’t live in a border state. He’s 73 years old. He lives in an area where vicious Mexican Drug Cartels and Human Traffickers run rampant. He’s alone on his property with his elderly wife.
It’s far too easy for people who do not live with this on a daily basis to render such judgments. All that said, the article states that Arizona Law allows for deadly force protection of one’s property. This judge knows this and abused his position of power to unjustly incarcerate an old man well within his rights under state law to protect himself, his elderly wife, and his property.

Actually, I’ve suggested a hedgewall ... drought tolerant bred with the nastiest thorns the species has to offer. The fill it with every imaginable native nasty poisonous critter and make the whole thing a bird sanctuary and get free enforcement from the Audubon crowd.

“a Mexican citizen” is an illegal criminal when breaking into a foreign country. The rancher should get bailed out by a wealthy celebrity.
