In another blow to President Joe Biden’s war on guns, a federal judge has reversed an ATF ban on so-called “ghost guns,” ruling that the president and his gun agency overstepped their jurisdiction.
On Friday, Texas-based United States District Court Judge Reed O’Connor said that the Bureau of Alcohol, Tobacco, Firearms and Explosives went further than Congress in banning the partially made guns.
“This case presents the question of whether the federal government may lawfully regulate partially manufactured firearm components, related firearm products, and other tools and materials in keeping with the Gun Control Act of 1968,” wrote O’Connor. “Because the court concludes that the government cannot regulate those items without violating federal law, the court holds that the government’s recently enacted final rule … is unlawful agency action taken in excess of the ATF’s statutory jurisdiction. On this basis, the court vacates the final rule."

The pistol brace “final rule”, next, we hope.
ATF does what they are told by DOJ. Administrations tell DOJ what to do (except for investigating Trump). This is not the way our government is supposed to work as this judge correctly noted, but how/why is this any different than the bumpstock ruling which was upheld by the courts after Trump told DOJ to ban them?
Outside of this ruling impacting far more people (far more “pistol braces” than bumpstocks) I don’t see how it is much different on the merits and it is the same principle at play - congress does not want to tackle hard votes so they rely on legislation through regulation.
This is a common practice across government but the only ones that seem to get noticed are firearms, woke stuff, or environmental rules.

Yeah, this is one of my misgivings about Trump.
All anti-weapon laws, rules and regulations are infringements of the 2nd Amendment.

Every Lowes, Home Depot and other hardware stores sell the materials to Make your own Firearm. 22 and shotgun are pretty easy, crude yes, but it isn’t tough.
Get that problem fixed and let’s say, a lot of people aren’t going to miss out this time.
Now if only they’d touch on the bans on MSR’s next, that’d be nice.

The Second Amendment is the only legal gun law in the whole USA and territories.
Everything else— EVERYTHING!— is either an infringement or a redundant restatement.
By the same logic this judged used — firearm parts are not of themselves firearms, and the ATF can’t re-write the laws the Congress has given it, even if the POTUS has ordered them to — pistol braces should be declared kosher shortly.
