Appeals court says Minnesota governor had authority to impose mask mandate

Gov. Tim Walz had the legal authority to mandate face masks when he declared a public health emergency in the early days of the COVID-19 pandemic, the Minnesota Court of Appeals ruled Monday.

Walz declared a peacetime emergency in March 2020 and mandated masking in most indoor public spaces in July 2020.

The conservative Upper Midwest Law Center sued, challenging the mask requirement as unconstitutional. Walz lifted the mandate in May 2021, at which point the Court of Appeals declared the case moot. […]

The appeals court rejected as “unreasonable” the plaintiffs’ assertions that the coronavirus “most likely” originated from a laboratory leak, so that the resulting pandemic did not occur “naturally” and therefore was not an “act of nature” under the state law. …

It does not matter that the masks didn’t work. The scientific evidence was that they don’t work and that they actually made people sick among other issues.

Governor is elected head of a state. He/she can execute orders legally and per state constitution. If the EO is stupid, there will be next election coming up.

The court decision was legally and constitutionally correct.

That seems like a weird argument for the plaintiffs to make. Maybe next time make a case that there has never been evidence that masks do a damn thing other than inconvenience and annoy the populace and allow those in positions of authority to extend their authoritarian reach.

The laws of the USA center around the recognition and defense of God-given rights. People like Walz and the judges involved here are on the assault of such laws, and intend to substitute the rule of men.

That is how you wish things were..Gods law and all.
In reality, congress makes federal laws with president’s signature. State legislature make state laws based on state constitutions. And there is 3rd branch of government who gets to decide if any law is constitutional or not.

The system is still in place. SOCTUS recently dismissed federal mandate on abortions. The system worked.

It was Woodrow Wilson who believed in “omnipotence of legislation” rather than Constitutional law.

I do not need to know what Woodrow Wilson believed. I can observe the current system at work with my own eyes. It is working like it is designed to work.

The problem is not with elected officials and courts. Those are elected in each election and can be removed by voters.

The problem is with UN-Elected bureaucrats who use their personal bias in doing their jobs.

Note that the guy in the article wore a “mask”.

So a facemask that won’t prevent someone from developing silicosis will keep out the coof.

Riiiiight.

And as a by the by, why did the great liberal state of CA, the same state that insisted on muzzles and lockdowns, allow the people the guy worked for to ignore OSHA and state regs?
