You must be refering to the Homestead Act of 1862, any U.S. citizen or intended citizen, including freed slaves and immigrants, could claim up to 160 acres of public land.
The Homestead Acts offered a more favorable opportunity compared to the promise of 40 acres and a mule.

Basically they could have their 160 acres, lot more than 40 acres and mule. But this offer has expired.
So by now, if they have not taken advantage of it, too bad, they missed their chance. .
