Michigan judges will be required to address people who appear in their courtrooms by their "designated salutation or personal pronouns...under a mandate issued Wednesday.
The court rule change divided the state Supreme Court 5-2, with justices who supported the changes saying they promote respect and fairness in Michigan's courtrooms, and justices who opposed the changes saying the court was unwisely wading into the culture wars.
The rule change creates a way for litigants to alert judges to the pronouns they use and their preferred method of address, allowing attorneys and parties to add personal pronouns and Ms., Mr. or Mx. as a preferred salutation to the captions of court filings.
Justices Kyra H. Bolden and Elizabeth Welch wrote concurrences explaining their support for the change. Justice Bolden explained that the rule is "not landmark" but "mirrors the expectations found in our judicial canons" that judges will treat all litigants with respect and without bias.
"The judicial canons already require treating every person with courtesy and respect without regard to a person's race, gender, or other personal protected characteristic. This amendment is merely a more detailed example of how judges must act to meet the requirements articulated in the canons, and it is in line with our antidiscrimination caselaw, statutes, and policies," Justice Bolden wrote.
"Adopting this amendment makes Michigan courts more welcoming and inclusive for all," Justice Bolden added.
Justices Brian Zahra and David Viviano, in separate dissents, chided their colleagues for wading into a hotly disputed political and social issue.
"By once again taking stances in a political debate, the court will not earn the public's trust, nor should it. Rather than instilling confidence, the result, I fear, will be to encourage the view that this court is a political institution," Justice Viviano said...

Nope. Won’t comply. It is incumbent on us to refuse illegitimate orders or mandates. I will never refer to a man as “she”, nor a woman as “he” anymore than I would say “good boy” to one who “identifies” as a dog. It would be tough enough to refer to the judge (any judge) as “your honor”.
