What I don't understand (not being a lawyer) is this idea of "undue." If you're innocent, you're innocent no matter how long it took to prove it.
If he had immunity, then he had it whether or not he brought it up then or now.
If it's an intrinsic power of the office, then it shouldn't matter that he didn't bring it up despite everyone else knowing that he had it but kept quiet because he didn't mention it first.
There shouldn't be a statute of limitations on his rights or the powers of his office.
