Hur overstepped mandate with ‘gratuitous’ Biden slams, say ex-DOJ Dems

Pointed language in special counsel Robert Hur’s classified records report drawing attention to President Biden’s age and cognitive ability is coming under fire from former Justice Department officials who say he overstepped his mandate in the case.

Hur ultimately declined to recommend any charges for Biden due to key weaknesses in the case: He simply did not believe he had enough evidence to convince a jury that Biden willfully kept the documents — the burden of proof in such cases.

But that detail is being overshadowed by how Hur described Biden, their interactions, and the president’s overall cognitive abilities in a report Democratic appointees to the Justice Department say crossed a line and skirted principles of offering neutral legal analysis.

They should have charged the family with espionage, like they would with any other American. Let the Jury decide. Senility is NOT an excuse, since it pre-dates his run for POTUS.

AFAIK. It was not lack of evidence that made Hur decline to recommend charges but how the jury would receive Biden. That is why his cognitive decline was mentioned in the report. Due to Biden likely presenting himself as a nice old guy who just couldn’t remember stuff the jury would likely believe that Biden was not capable of knowingly committing a crime.

On today’s show Bongino says the Hur report was an Obama/Clinton hit on Biden. I’m not so sure, or a lot of their lackeys in the press would be calling for him to step down. The press could be decisive in tipping him over right now, but they’re not doing that.

Don’t get me wrong. I’m pulling for Joe. I want him on the ballot on Election Day and I think we can crush him

No, he said that Biden did willfully keep the docs. In fact he told his ghost writer that he had the docs. And further, he read them to the writer who recorded Biden reading from the docs. Hur didn’t prosecute because he believed (or so he says) that a jury would think that Biden is just a demented old fool, which according to the latest polls 90% of Americans agree. Hur needed some way to not prosecute. He took the most obvious route.

I was listening to the White House press secretary going on and on abut a REPUBLICAN special counsel. Confused, as I thought we only had US attorneys, US special counsel, and that they worked for the US Attorney General Merrick Garland, a Biden nominee. And didn’t Attorney General Garland have to sign off on this report? So, this is a Biden administration report about President Biden. Nothing Republican about this.

If Biden is sharp, clear headed and totally “with it”, then there is no reason he should not be charged with willfully and admittedly violating Section 1, subsection e) of the Espionage Act.

That statement is inaccurate.

Hur was very clear why he did not feel he could prosecute: Biden was so befuddled during the interviews that it was pretty clear the defense would be able to show he could not form the “intent” necessary to convict.

That is very different than not being able to prove he did it. That is, on its face, clear to everyone.
