The EPA is a leftist bureaucratic nightmare that is now pretty much only used as an (illegal, IMO) enforcement and political policy tool. IIRC, there was a recent USSC ruling on non-legislative administrative rules and regulations involving the EPA et al that may have some sort of impact or consideration here should manufacturers collectively balk at
