Student accused of viciously beating aide in viral video blames school in new lawsuit: 'Ticking time bomb'

The Florida high-school student with autism accused of violently attacking a teacher's aide over a Nintendo game has filed a stunning lawsuit against the school district, accusing it of failing to make interventions to address his bad behavior even though he was said to be a "ticking time bomb."

Brendan Depa, 18, has filed a lawsuit against Flagler County Public Schools, accusing the district of failing to meet his needs in the lead-up to the shocking February 21 incident that was caught on video and went viral.

Depa was 17 when he allegedly attacked teacher's aide Joan Naydich at Matanzas High School in Palm Coast. Surveillance video released by the Flagler County Sheriff's Office allegedly shows the 6-foot-6, 270-pound student running up to the teacher's aide, pushing her to the ground, and then continuing to punch and kick her.

The teacher's aide is seen on the ground for several minutes before getting up with the help of others.

Naydich told FOX 35 Orlando she had suffered five broken ribs, a severe concussion, loss of hearing in one of her ears and other issues as a result of the beating.

And this is why I’m trying to get out of education. I’ve taken a summer job at a Florida based grocery store that I hope will become a new career (it’s a great, nationally known store.)

The employees are actually treated very well, and not often stomped half to death by tantruming students. Education is a joke, especially in Florida.

Teachers and administration are required by federal regulations and Law to treat these crazies as normal studious students. They may not “discriminate” on the basis of insanity, especially if the hulking loons are black.

That argument sounds like something his white adoptive mother cooked up. She is, I believe, some kind of social worker herself. She is very articulate and knows the various tropes many rely on to absolve disabled people of any responsibility for what tbey do.

The real issue is that the states have closed the institutions. Instead, the states are placing young people who need institutional care into the schools.

That is what happened in this case.

From what I recall:

He really is intellectually disabled. His parents adopted him as an infant, and they homeschooled him. But, when he grew big and strong, they could no longer handle his outbursts, so they placed him in an institution.

But, the insurance company refused to continue paying for his institutional care, so he was sent to a group home.

But, the group homes put their young residents into the special ed programs in the public school system. That is, the states have been using the public school system as “day programs” for intellectually disabled young people.

Brendan’s own parents argued that he should NOT be put into school, but he was placed there, anyway.

And now look what happened.

He was NOT the first special ed student to attack an aide in this school system. Two others (both white and older than he is) attacked aides there. Neither was sent to prison. IIRC, both returned to their group homes.

Aides have been attacked in other schools, too. At least one aide was killed, but no one is paying attention to that case.

He should be living in an institution - NOT in prison.

I agree. After 30 years in the public school system l retired. Oh the stories l could tell! I then became a substitute teacher. One day l was assigned a Special Ed class. There was a student who was over 6 feet tall crawling on the floor. He kept trying to get to me but the aides held him back. They ask me to leave because they said he “liked me”. I did not ask for further explanation. I just left and was paid for a full days work after on 30 minutes. Some of these children should not be in the Public school system. There are violent autistic students who need intutional care.

I believe you. For years, I’ve seen job openings for paraprofessionals to work with special needs teens and adults. As desperate as I was for work, I never applied for those jobs. I might be able to help young children. But, the teens and adults would be bigger and stronger than I am. I’m not the right person for that job, just like I’m not the right person to be a nurse, a firefighter, or a police officer. It takes a special kind of person, and I’m not that person.

I don’t believe the woman who was attacked is the right person for the job, either. She took that position, but she still doesn’t seem to understand it.

P.S. Most of these kids are sweet. They have more to fear from the “normal” kids, and they’re sometimes abused by teachers and paraprofessionals. But, they should be in separate schools, too, for their own protection. JMHO.

This mindset suggests that ALL people dealing with mental illness can't be held responsible for their actions. That sounds, to use a woketard phrase, ABLEIST. Growing up my kid brother had a mental illness because of a slight learning disability which he eventually learned how to compensate for. I worked alongside Veterans who were in Vietnam, Desert Storm, Desert Shield who dealt with PTSD. They all had a much clearer cogent sense of right and wrong and had much bigger hearts than many so called "normal" people I've known.
Can't help but wonder if that "mentally ill" thug would've gone off the same way on someone like, say, Mike Tyson, Floyd Mayweather, Connor McGregor, The Rock, Rhonda Rousey, etc. They can't be held accountable yet they can determine who the "soft" targets are. Crazy how these psychos rarely if ever pick on anyone their own size
