Utah bans doctors from assigning ‘DNR’ orders for children without parental consent

A new Utah amendment set to take effect on May 1 will prevent children from being assigned “do not resuscitate” (DNR) status without parental consent. Under the amendment, such an action will be considered “unprofessional conduct for physicians, advanced practice registered nurses (APRN), and physicians assistants.”

HB-0200 modifies Titles 58 and 75, ensuring parental rights are protected during a minor’s life-sustaining medical treatment.

“No child’s medical chart should have a DNR order or the withholding of life-sustaining treatment without parental knowledge or consent,” said Simon’s Law CEO and co-founder Sheryl Crosier. Sheryl and her husband Scott founded Simon’s Law when, after their son Simon’s death, they discovered a DNR order on his medical chart, which had been placed there without their knowledge or consent.

Simon was born in September of 2010 and at three days old, he was diagnosed with Trisomy 18, also known as Edward’s syndrome. When his oxygen levels began to drop in early December, doctors told his parents, “This is the end. Nothing can be done.” But once Simon had died, nurses indicated to the Crosiers that they had been prevented from helping Simon and that they should look at their son’s chart. On it, Simon’s parents saw that a DNR order had been placed in his medical file against their knowledge.

“I can’t bring my son, Simon, back,” said Sheryl, “but I want to make sure that no parent or guardian of a minor child is stripped of their parental rights in the determination of their child’s life or death.”

In addition to protecting children from non-parental DNR orders, the amendment also protects parental rights regarding life-sustaining treatment for their minor child. When reviewing Simon’s chart, his parents noticed that he had only been receiving comfort feeds, which did not provide enough nutrition for growth and development. In addition, Simon had been given Ativan (lorazepam), a drug they later learned suppressed his respiratory system and was contraindicated for his apnea.

“Unkown to us someone decided our son’s life had no value,” said Simon’s parents on the Simon’s Law website. “Without our knowledge or consent someone decided to withhold care, administer medications to hasten death and order a DNR to finalize Simon’s life.”

Utah is the 12th state to create such an amendment.

So the State has every right to reassign your child’s gender, perform an abortion on them, and now kill them too. Without parental consent.

IF I'm reading it correctly, this makes doctors tell parents they want to DNR their kids. This isn't the state doing anything really - it gives the parents the rights to know what care their kids will be receiving.

Yes. I should have said how the state of Utah USED to have the right to kill your child without parental consent.

I wonder how many other states have not made this illegal?

Brings back memories of working NICU. If the doctors didn’t like the parent’s “no,” they’d take the case to the ethics committee and court. Refuse a blood transfusion for your baby, and find how much they’re already owned. And those PKUs on everyone- the X-Files movie outed that and some still know why it was originally implemented. What can track to save can also track to kill. Putting power back into the hands of the parents is a good thing.

I’ve always been told that more murders have been done by doctors/nurses in the health care industry than serial killers like Ed Kemper or Ted Bundy.

Just like the abortionists, that they look down upon they will see those babies one day when they stand before God and it won’t be pretty.

I’ve also said there is high drug use among doctors and nurses in a lot of hospitals, maybe this is why. You can’t run from your conscience.

A 2006 study examining 90 cases of healthcare serial killers from twenty different countries between 1970 and 2006, found that 86% of those who became serial killers within healthcare were nurses, both male and female.

Further research has categorized healthcare serial killers in accordance with their motives. These categories show the range of motivations and psychological rewards achieved by those in the medical profession who kill their patients. According to Dr. Khin Khin, they can often be categorized into the following groups:

Thrill Seekers – these are individuals who achieve a thrill from the act of killing, a thrill that they want to repeat over and over again.

Power Oriented – in this group, they kill to achieve a feeling of power and control. Dr. Harold Shipman is an example of a medical serial killer who falls within this category.

Gain Motivated – these individuals receive something from the act of killing, this may be relieving a burden by removing the patient from their care or they may be able to steal money or belongings from the patient.

Missionary Killers – less common, these are serial killers within healthcare who believe they are doing a good deed by getting rid of people who are “immoral or unworthy” in some way.

History of mental instability

Preference for night shifts, or shifts with fewer staff and supervisors on duty

History of difficult personal relationships

A tendency to ‘predict’ when a patient will die

Felt patients were a burden to them and an annoyance

Had a problem with substance misuse

Often moved from hospital to hospital

Even without this law, how would doctors (or anyone) not the legal guardian have the non-emergent authority to place a DNR on any kid? That just screams for a revoked license!

I guess I'm safe then....I wasn't an RN..I was a RRT CPFT NPS...Ha!!

I caught a MD...doing something once..to a woman on a Vent. I took it to the top. That was worthless. I saved the woman....and that's all that mattered.

The information on PKU tests was largely scrubbed the last time I did a search, but I found a research paper this time with a hint at the truth of why the test was developed- it was (supposedly) to save Jewish babies from this rare disease. What starts with good intentions can easily be hijacked. Add to that- how ethical is it to add an “experimental” test for HIV/AIDS with no follow-up or notification of the parents? Don’t you love how they know secrets about us even we don’t know? Like Haman, they’ll be hung on the gallows made for others.
