Judge Denies Blake Bail Again

A Los Angeles judge has denied bail to actor Robert Blake, who's been in jail since April 18 in connection with the murder of his wife.
Judge Lloyd Nash said his decision does not mean he believes Blake is guilty of murdering Bonny Lee Bakley.
According to The Associated Press, Nash said he had reviewed hundreds of pages of documents submitted by both sides before the hearing, but could not "make findings of fact without hearing evidence."
Nash says he'll reconsider his bail decision after an upcoming preliminary hearing, in which witnesses will testify. The hearing had been set for December.
A somber-looking Blake furrowed his brow as the decision was announced. He had entered the courtroom smiling at his family, but left looking at them with a sad expression.
Blake's attorney, Harland Braun, took the battle for a hearing all the way to the California Supreme Court, which wants Los Angeles County authorities to explain why they are keeping Blake in jail without a chance for bail.
Blake's been in jail since he was charged with murdering Bakley in May of 2001.
Braun claimed the authorities keeping Blake in jail should grant bail immediately because the prosecution simply wants a tactical edge.
But prosecutors said Blake should be denied bail, and that there's plenty of evidence against the actor.

Bail during the legal process is a constitutional right. The only flight risk would be Baretta's bird. It's not like he is one of those people who fled the country over the DNC methods of fund raising. Guilty or innocent the man is entitled to bail.
The judge seemed pissed he had to hear from the Calsupremes over this. He said that he was told he must hold a hearing to determine if he should hold a hearing on bail for Blake(ridiculous wording I know) and that to make things more efficient he would just hold the bail hearing now. Gee what a swell guy!
People need to realize Blake has not even had a preliminary hearing yet.
That bit about the three bullets missing from a box of reloads vs. the three actual loads in the gun NOT BEING RELOADS sounds very fishy to me. Blake most likely did it IMHO but if the LAPD starts manufacturing evidence again, they may just get blake off.

I actually feel rather sorry for Mr. Blake. The man ought to be in a facility receiving psychiatric treatment, not sitting in jail. He's been suffering from mental illness for quite some time.

If the defendant is likely to tamper with witnesses, make statements to media in order to try the case in newspapers, poses a serious flight risk(must be demonstrated by network of friends, banking, relatives, and prior travel history. Not just because the LA DA said so.) I can see bail being a non likely situation. This guy has children, family, is highly recognized, has real property and assets here in this country, and should be granted bail.
Once he is tried and found guilty, that means he won't see much of LA no more! If he is innocent, he will be broke, destitute, and cast out from his peers. No reason to keep him in lock-up without bail exists IMHO. The massive resources of prosecution can say, do, suggest, manufacture anything in it's efforts to win a conviction. Blake deserves bail to help him prepare for that. IMHO it was denial of bail that helped to get OJ Simpson off.

Can you explain to me a "Non Special Circumstances Homicide?" Short of a skydiver not opening his parachute and landing on a pedestrian, I cannot imagine too many homicides that are "Normal Circumstance Homicides" ;)

In addition to the criteria you've already mentioned,
the seriousness of the charge is often another reason invoked for denial of bail. In this case, the charge is (obviously) quite serious.
In answer to your question concerning "special circumstances" homicide, in California this is a class of homicide that not only impacts on penalty but also on questions of bail. "Lying in wait" is one of these special circumstances and it is what Blake is charged with. If a defendant is believed to have cold-bloodedly calculated the murder with which he is charged, there is ample room for the presiding judge to deem him too great a threat to the community to release on bail.

I saw some show on TV that gave some of the details on the case and his relationship with Bonnie.It seems she was basically a celebrity hound,who attempted to court many different celebs,until she finally scored with Blake.I agree he should have a thorough examination.The guy allowed himself to be used,and it appears this all led up to him snapping.Sad...........

Well, that eliminates Bobby as a suspect in the DC area shootings. On the other hand, we could use the proven skills of Baretta, or at the very least Matlock, in helping to solve the case.

I found this thread from last month and thought I'd post a reply from here.
Tonight on KCAL news, Blake was AGAIN denied bail, will have to sit behind bars until Dec. 11, which is his prelim. hearing.
I hope they keep the sorry SOB in the slammer... where he truly belongs!

Guilty or innocent the man is entitled to bail. I believe the police found evidence that he was preparing to flee the country. This would be sufficient reason to deny bail in a capital murder case. He is probably where he belongs. Don't do the crime if you can't do the time...

I would say it's a pretty level playing field. Blake is going nowhere. Let him go kill himself in shame. It will save the taxpayers a lot of money. Of course Court TV will be upset though.

I watched as two guys got eight year sentences for beating their father to death with a baseball bat on the news today. Unprovoked, without cause, and without feeling. They then set fire to dad's house to try to cover it up. They got additional eight year sentences for arson to run concurrently! That means they will be out of jail in three years from the day of sentencing.
Bonnie and Robert(Mickey) deserved each other. She of course did not deserve to be killed by anyone, but society has become so out of focus and maligned in degree of victimhood we have no practical sense of justice in this country.

Only difference is between Blake and those two boys is that I feel sorry for those boys. The environment they were raised in. The unfit parents. I'm glad they got 7-8 years.
Blake can go to hell. I read on a Blake message board that a poster has talked to Blake in jail recently. This poster said that Blake told him that he feel he's "slowly dying" literally in his jail cell. Now he knows how it feels, at least Bonny suffered less. Scumbag.

I didn't post it because I knew the rules on bail. Our judicial system says innocent until proven guilty, unless you're a relative of the deceased.

Unfit parents and poor environments are a mixed bag. I tend to lean Dickens. Would it be ok if Bonnie continued to operate porn services from the home raising her kid? Would it have been ok if the kid shot Bonnie because of being raised in the middle of a porn business from the home? We would all be making excuses then and demanding Blake be put in jail for sexual abuse to the minor.
We are a goofy nation. You say you feel sorry for those boys. Well justice has nothing to do with "feelings", it has everything to do with application of laws enforced equally and universally to each and every American in each state.
