That is good. 114. Out of how many. How many people did DNA find did do the crime? What is the percentage. If it was 114 out of 120, I would say we have a big problem. If it is 114 out of 100,000, then I say that while there may be a problem, it is not a big problem.

Food for thought:
In cases where the evidence is the strongest, a death penalty is less likely to be handed down.
First of all, good evidence will lead down the plea-bargin route, where the (guilty) defendant is likely to confess in exchange for life in prison.
Secondly, securing a jury conviction against an innocent person is more likely to lead to a death penalty because the defendant is "unrepentant" in the minds of the jury.

Without actually coming out and writing it, they believe it better to let one innocent man hang, than for ten guilty to go free. Another pyschic writer. To make his point he creates a pretend bunch of people that he can villify. Sorry Charlie, most everyone has said they need to see more evidence before starting the fatal drip. Typical Sierra Times article.
He goes on to accuse jurors in the cases he cites as being immoral and "flippantly" renedering death sentences. I'd say he's the one with the disregard for the truth. Wonder how many of those jurors he actually talked to before he sentenced them?

Saying the jurors "flippantly" convicted these men without individually examining all 114 trial is irresponsible. Surely some of these jurors and trials represent resonable judgements based on the facts presented in court.
If these trials had witnesses who claimed to have seen the crime, and the defense was not able to discredit these witnesses or their testimony, what would the author expect them to do?
These are not cases where the forensics evidence was ignored. The DNA testing either was not available or was not done at the time.
To judge a decision based on information that wasn't available at the time it was made is highly unfair.

Now, it isn't that I believe Scott Peterson is innocent or guilty. That is not the issue. The problem is that, based upon the facts known in the public realm today, there is no way I could send Scott Peterson to a lethally injected death, because as a responsible citizen and potential juror, I am required to assume innocence unless proven guilty to the extent that there is simply no question about it. That's not quite right, but it's the way it should be in cases of capital punishment. The usual criteria is guilt beyond a reasonable doubt. In cases of capital punishment, that's clearly not good enough, since you can't unhang somebody. The criteria for capital punishment has to be beyond any doubt, whatsoever.

I can envision a situation where there would be enough evidence for a death penalty, but as a juror, I would have to be a certain about it as the sun rising in the morning.

95% of the people I talk to are not only convinced of Scott Peterson's quilt (based on the circumsatantial evidence and information released so far) but have volunteered to "pull the switch"!
I'll wait for the trial to end before I make up my mind.

Yikes, I am surprised to read that based on the facts you know that you couldn't send Scott Peterson to a needle injected death. Seems a tad bit premature don't you think? No evidence has been presented in a court of law yet, therefore that conclusion is as bad as having him convicted already.
What I have seen however from his defense with it's ridiculous satanic cult theory makes me think that we have an attorney who knows he has a guilty client. Why else throw such an outrageous bunch of garbage out there to the potential jury pool?
