Petitioners are a group of California gentlemen, good citizens, placed at great risk and disadvantage by California legislation restricting firearm ownership. Plaintiffs would like to exercise their right to possess…In much the same manner as did the founders of the Constitution and authors of the Bill of Rights.

Plaintiff Patrick Overstreet is a resident of Marin County …. He is employed by the San Francisco Police Department as a S.W.A.T officer, and is a graduate of California State University..

Plaintiff SGT. Steven Focht … performed military functions in Desert Storm … He was honorably discharged, and currently is a Sergeant in the California Army National Guard.

Plaintiff SGT David Blalock is a resident of Sacramento County …. He was assigned to the 82nd Airborne Division and is a Purple Heart recipient from combat injuries… He is currently a Sergeant in the California Army National Guard.

This argument is for grant of relief court ruling restricting ownership of firearms. Presently, the Courts of Appeal are in serious conflict over the requirements for standing of litigants to challenge restrictions on the Second and Fourteenth Amendments right to keep and bear arms.

This is the first United State Supreme Court challenge of the right to own firearms in sixty years. The last case was the Miller case.

They should as the lower courts are in complete conflict, but they can be so gutless.

Good point. There's a small town in the west, with a population of 2500 citizens. This town has 5 policemen. Which 5 citizens should be chosen to receive protection? And which 2495 citizens should be unprotected if they are denied the means of self-protection?

Not true ... both Haney and Emerson last year also did the same. However, those cases were denied cert.

I hope the next court, assuming it's got a better makeup than this one, is the one to grant cert.

Remember, this is the court where the majority is comfortable citing the "growing consensus" of "western civilization" as exemplified by courts in France and Zimbabwe for their decisions. This court will conclude that the profound desire of the world to rid itself of these fowl tools of the devil (played in the movie by Charlton Heston) justifies ignoring the 2nd amendment, whatever it may mean.

That's 1 officer per 500 people. My town of 9700 people has 8 officers. On average, there are only two on duty at a given moment. We do have a shall issue CCW policy and people do carry. We've had one firearms related death in the past 4 years. A cop took out an armed suspect who attempted to shoot him.

Notice that all three are members of a "militia".

I smell a rat. A set up to coax the court into subsidizing the militial arguement.

Issues of national importance should NOT be sent to every state, but you knew that.

If everyone engaged in such abuse, the state lists (supposed to be for LOCAL state issues) would be worthless.

Thanks for your contribution to making one of Free Republic's features more worthless.

With 80 million firearms owners, The logic would follow that firearms owners exist in every state, and that every state has Freepr membership.

These petitioners are self sponsored, with support from KABA organization and perhaps SAF. As of yet NRA has not attempted to elbow in like they did in DC. I know the director of KABA a personal friend, straight shooter, good guy.

It will be interesting to see if if the court grants the petition.
