Here's a link to a story today in the Mercury News that deals with Fogel and his decision. Gives a bit more info on his backround. And notice that the author of this article neglects to mention anything about who many of the recipients of the overseas ballots might be...

Then, at a preliminary hearing which Relator attended as a gallery witness, on October 31, 2000 A.D., Judge Fogel dismissed said CROSS-COMPLAINT sua sponte, but without a proper motion to dismiss having been filed. Then, Judge Fogel openly admitted ‑‑ on the record, in open court, and in a verbal admission witnessed by Relator ‑‑ that he, Jeremy Fogel, was practicing law. It is a high misdemeanor and impeachable offense for a federal judge to practice law from the bench. See 28 U.S.C. 454 and 18 U.S.C. 242.

It is time for Kalifornia to defy the court.We simply cannot allow one person to tell the masses what to do.Besides,it would be impossible to arrest that many people.

It is my understanding that Reinhardt and Fogel are federal judges, and thus immune from the CA recall statute. They would be subject to impeachment, but a 2/3rds vote of the Federal Senate would be necessary, after a majority vote in the House. Ain't gonna happen.
