Al Franken has good buzz and bad buzz as he prepares to face the Fox News Channel in court tomorrow.
The good buzz is that Mr. Franken's publisher is seeking to ride the publicity wave by rushing to release his book today

On Aug. 11, the nation's top-rated news cable channel filed an 8-inch-thick complaint against Mr. Franken in a Manhattan court, accusing him of trademark infringement on its "Fair and Balanced" slogan, calling him a "parasite." That statement is an insult and Fox should immediately appologize to all parasites everywhere.

Franken and his publisher better pray they win this lawsuit. The book was rushed out not only to capitalize on the publicity (which won't get them very much at all in extra sales;
see this post for the reason why), but also because they obviously believe it will help them beat the lawsuit. Basically they're saying to Fox, "Hey, the book's already out there! What are you gonna do about it? Do you think the judge is
really gonna make us recall all the books? Nyah nyah!"
Well, they're going to be quite surprised when the judge does exactly that. Judges don't take well to cheap tricks like this, and if this judge sides with Fox, Dutton's rush to get the book out before the suit was argued is a virtual guarantee that the judge WILL order a complete recall of all unsold copies, and issue a much higher damage award to Fox than they otherwise would have gotten, possibly enough to wipe out all profits on the book.
