Some private behaviors - e.g., prostitution, gambling or drug taking — involve corollary criminal activities or public health issues, thus there is a legitimate state interest in banning those behaviors. In addition to its flagrant assault on societal moral standards, homosexual sodomy is a major source of the spread of AIDS (which incurs enormous health care costs ultimately passed on to the public), and thus warrants such status.
However, Justice Kennedy, his cohorts and his predecessors went even beyond violating the 9th and 10th Amendments (thus overruling the will of the people), for they specifically delineate homosexual sodomy (like they did with abortion) as a Constitutional right! Is the woman-on-top position similarly protected, then, or how about doggie style? The Lawrence vs Texas ruling provides grounds for just such ridiculous arguments, revealing its error. Any reasonable perspective — outside the ideologically driven dismantling of the original intent of the Constitution and the discarding of traditional Judeo-Christian moral standards - immediately shows the folly of Kennedy's reasoning, and of this ruling.
Compare the nebulous justifications given by Kennedy with Justice Tom Clark's majority opinion in Mapp vs Ohio (1961), one of the original 'right to privacy' cases, which excludes evidence that the police obtain in violation of the 4th Amendment: "Our decision, founded on reason and truth [italics mine], gives to the individual no more than that to which the Constitution guarantees him..." Not legal contortions or ideological rhetoric …just 'reason and truth,' and the Constitution's original intent.
Today, 'reason' has become 'spatial and transcendent dimensions' or 'penumbras and emanations,' and 'truth' no longer even has any standing in this nation, legally or otherwise. Instead of facts, courts now try to determine intent, as if that overrides actions and their results on human lives. The truth of this matter is that homosexuality is destructive of individual lives, and of society. Justice Clark also wrote: "There is no war between the Constitution and common sense. If the Government becomes a lawbreaker, it breeds contempt for law; it invites every man to become a law unto himself; it invites anarchy." The Lawrence ruling flies in the face of common sense, and Kennedy's words indeed invite every man to become a law unto himself, just as the Supreme Court has become.
Supported by this ruling, homosexual activists are preparing to sue the military to overturn the 'don't ask, don't tell' policy, allowing open homosexuality in the military. Also, as soon as some state follows the logical rationale of Lawrence and makes 'homosexual marriage' legal, the Court will quickly force all other states to recognize them. No way? Under the 'full faith and credit' clause of Article IV, Section 1 of the Constitution, there is no avoiding it. It's not a matter of 'if,' only 'how soon?'…and the activists are already busy.
'A man must stand for something…or he'll fall for anything.'
Most of us have seen men and women fall for all manner of lies and deceits, and wondered at the blindness that led to their ruin. But what is true for men is also true for nations. The Lawrence vs Texas ruling is but the latest evidence that this nation no longer stands for its Founding moral and political principles. For thirty years we have been witness to the moral decline of our nation, seeing it turn to foolish, destructive, empty things disguised with false claims of justice, equal opportunity and tolerance.
However, it's not the fault of the atheists and agnostic intellectual elite that G-d has been removed from the schools, courthouses, parks and even Christmas. It's the fault of those who know better than to fall for their nonsense, but who did, and do, little or nothing to stand against them. When the Roe vs Wade ruling was issued in 1973, where was the Church? Where is it today? Where are the true Conservatives? Too many are like this 'conservative' Supreme Court! Our complacency has enabled the man-centered ideas of the elite to gain ascendancy in every area of human life, from the local schools to the halls of Congress and the White House.
Long before the recent Supreme Court decisions, our national rejection of G-d and abandonment of our Founding moral and political principles made this ruling, and worse ones to come, inevitable. But 'rejection' involves a conscious, willful act. We haven't lately displayed the personal or national character for decisiveness, but have simply gone along with various minority groups, whose self-interest and amoral agenda drives them to speak louder and act more boldly than us.
Like cattle at the slaughterhouse, some Americans are just now beginning to realize that we've cooperated in our own demise. Sadly, many still don't 'get it,' and won't until oppressive government or moral decay actually touches them personally. But humans shouldn't have to put their hand in a fire to know that it burns, and America shouldn't have to go down this amoral road of 'personal autonomy' that others have already traveled to know the result can only be national disaster. The evidence is already piling up around us.
Yet like the British of an earlier time, who clung to the image of their great empire long after it had failed, we refuse to acknowledge our demise. In place of moral principles, we offer feeling, as if emotion were the only valuable human trait. A perverse 'compassion' has replaced clear moral and political standards, rationalizing all manner of stupidity and evil, always disguised as a good - for the children, for the poor, for the minorities and dispossessed, etc.
Most Americans hold themselves above the political messiness, leaving it to the various activist groups that pursue only their self-interest. These avant-garde minorities, through their media savvy, ideological zeal and political activism, have overwhelmed the quieter voice of the majority who still hold to the traditional, Bible-based standards of morality. We have appeased the radical humanists, libertines and vainglorious, self-absorbed crowd at every front, thinking it couldn't get too bad. Well, if it's not 'too bad' for you yet, just keep sitting and watching, doing nothing.
What irony, that it is a supposed 'right to privacy' that upholds the flagrant public displays and increasingly bold and obnoxious behavior of homosexuals. That homosexuality seems to have increased in modern society is indicative of how much they've been emboldened by our acquiescence, for they're simply more vocal and more visible than before. With this ruling and the ones certainly to follow, I shudder at what another ten years of our moral torpor will bring.
For those of you who believe the Conservatives or the Republicans (they're not the same thing!) will save the day, I ask: Well, where have they been? Congress can override the Supreme Court's rulings when they're so outlandish and unconstitutional…but they haven't even attempted to do so. Yesterday I read where the Log Cabin Republicans, the homosexual branch of the GOP (yes, there is such a thing) brag that they are consulted weekly by the White House on policy issues. C.S. Lewis had something pertinent to say about placing our trust in political parties or politicians: 'He who surrenders himself without reservation to the temporal claims of a nation, or a party, or a class is rendering to Caesar that which, of all things, most emphatically belongs to G-d: himself...'
That is the problem, of course. The current immorality is the only possible outcome of our abandonment the original and only valid foundation for moral standards, G-d (through His Word, the Bible). If that offends you, perhaps you'd like to compare notes on the impact of that 'old, repressive' way of thinking and your 'modern and open-minded' philosophies? Seems that when Biblical morality was the norm, this nation and its people thrived and prospered in every way. In the past thirty years, though, everything from public behavior and private morality to the economy, the level of political discourse, entertainment, etc., has declined. Amazingly, some call that 'progress.'
In the 70s the homosexuals said 'Just leave us alone.' In the 80s, it was 'Just acknowledge us for what we are.' The 90s, though, brought 'outing' and 'Queer Nation.' Now, the Supreme Court has given perverse sexual behavior the legitimacy and authority of the supreme law of the land, making homosexual 'marriage' a certainty. Do you not wonder what comes next?
In his Farewell Address, George Washington said, "Where is the security for property, for reputation, for life, if the sense of religious obligation desert the oaths which are the instruments of investigation in courts of justice?" In the 'right to abortion' the first of the inalienable rights, the right to life, has been discarded. Now, thousands of years of human experience and tradition, not to mention the clear teachings of the Author of those rights, have been similarly tossed aside.
For those who think themselves so sophisticated, and too intelligent to 'fall for' religion, Washington gave a warning. Noting that '…virtue or morality is a necessary [italics mine] spring of popular government,' he speaks to today's godless nation: "And let us with caution indulge the supposition that morality can be maintained without religion. Whatever may be conceded to the influence of refined education…reason and experience both forbid us to expect that national morality can prevail in exclusion of religious principle." In other words, national morality equals liberty…they are inseparable.
I once believed that man's intellect is all that's needed, that we can figure out the right thing to do without some meddling, omnipotent fantasy figure. I was 'too smart' to fall for religion, which I believed sprang out of man's fears and ignorance. But, by the grace of G-d, I finally saw the truth, that all along I actually was falling for something, only it was the self-serving lies of mankind (and the devil himself)…that we don't need G-d. The Bible actually calls that 'The Lie;' it was believed by Eve in the Garden, and it will be believed even after Jesus takes His true Church out of the world.
I once wondered at how that would be possible, but no more. Anyone who can witness the moral debasement that has occurred in this country the past thirty years, yet still hold to the arrogant assumption that man is sufficient unto himself, is a fool, and capable of believing all manner of lies and foolishness, even in the face of mounting evidence to the contrary. The Lawrence ruling is fit for, and would only be tolerated by, a nation of such fools.

As far as public health goes, the same could be said for drinking alcohol, smoking cigarettes & eating unhealthy foods.

Enormous health care costs are also incurred by those who smoke cigarettes, drink alcohol & eat unhealthy foods.
Justice Clark was on the right track, but he didn't quite get to the end. It may invite anarchy, but what it brings is tyranny.
Here's an idea:
Leave health care costs to be covered by the sick ones or their insurance carriers; not by taxpayers.
The above is true, but I don't want the government running around trying to tax or prevent all activities which are potentially harmful. What about motorcycle riding? Hunting? Bungie-Jumping?
Which is my point. I don't think prostitution, gambling, drug-taking or sodomy should be outlawed -- and I'm not a Libertarian -- just someone who actually believes in small Govt & not a so-called conservative who believes that the force of Govt should be used to prevent their neighbors from doing "harmful" things.
