Which cases? What foreign arguments? I wasn't aware of this.

The recent opinion by the supreme court regarding homosexual rights was the one that most sticks in my mind which applies foreign laws to the US.

Foreign courts and court cases were cited in both the Texas sodomy and Michigan affirmative action decisions.

Subsequently, while addressing the American Constitutional Society (the lib equivalent of the Federalist Society), Justice Ginsburg bragged extensively on this aspect of those decisions. She voiced her intention that SCOTUS should use its postion to increasingly bring American law under the sway of "international standards".
