SEC faults Geragos on client funds

SEC faults Geragos on client funds

Scott Peterson's lead attorney, Mark Geragos, faces civil contempt of court charges on suspicion of soliciting and accepting $50,000 from a client whose assets had been frozen by a federal judge in Rhode Island.

The Securities and Exchange Commission wants to have Geragos and George Buehler, another attorney from his Los Angeles-based law firm, held in contempt of court, according to documents filed last week in federal court in Providence.

Geragos denied wrongdoing and predicted victory. He suggested that federal officials, with whom he has tangled in the past, are trying to publicly discredit him and economically disable his client.

"We'll file the appropriate paperwork," Geragos said Wednesday, "and I expect they will withdraw their application."

Geragos is steering Peterson's defense against double-murder charges in Modesto. Authorities say Peterson killed his pregnant wife, Laci, and their unborn son, Conner. Their bodies were recovered along the San Francisco Bay shoreline near where Scott Peterson said he fished alone the day his wife went missing.

Laurie Levenson, a law professor and director of Loyola Law School's Center for Ethical Advocacy, said the developments would have minimal impact on public opinion.

"People are going to use this to see what they already believe," Levenson said. "For some members of the public, they'll say, 'See, he's a slick lawyer. He can't be trusted.' Other people will think they're trying to throw mud on him."

But she noted the stakes are high in a capital murder case.

"You want to have as much credibility as possible when you go before the jury in a death penalty case," Levenson said. "Anything that distracts from your credibility is a serious issue."

The SEC also has asked for civil contempt charges against the Los Angeles accounting firm Laffer & Gottlieb, which authorities contend helped Geragos' firm and received $41,350 from a frozen credit account.

Geragos said the money was not covered by the judge's order.

He confirmed that he directed Buehler to seek payment from their client through credit cards and insisted that it's legal to do so. Banks provided the money in a line of credit; that source is not tied to the client's assets, Geragos said.

The SEC's allegations stem from a civil case brought in April 2002 against eight people, accusing them of swindling $20 million in a fraudulent investment scheme. They had promised investors returns of nearly 300 percent in 12 banking days, according to the SEC.

The group solicited $52 million from investors and returned $32 million, according to the SEC. Officials reported that the remaining $20 million was "misappropriated, transferred or lost."

Geragos' firm represented two of the defendants:

Police Searching Bay For Peterson Clues

Police Searching Bay For Peterson Clues Gag Order Prevents Authorities From Sharing Details

POSTED: 4:39 p.m. PDT September 19, 2003
UPDATED: 5:12 p.m. PDT September 19, 2003

New activity in the Laci Peterson case Friday.

Police confirmed with NBC11 that they were back in the water Friday afternoon, searching the waters not far from where the bodies of Laci and her unborn son, Connor, were found.

Because of a gag order in the case, authorities are not able to confirm what they were looking for.

The Contra Costa County Sheriff's Department did confirm that it was assisting the Modesto Police Department.

Sandylapper good to hear, that Isabel is just a memory.

Sandylapper, runningbear and Jackie-O do you think that maybe LE wants to signal Geragos, that he can delay, postpone and put off the preliminary. But the prosecution has every intention to use this extra time to gather, more evidence.Gotta love it.

Geragos, Cadee Condit making Modesto night scene

By GARTH STAPLEY
BEE STAFF WRITER

Published: September 20, 2003, 07:57:21 AM PDT

In the space of 19 months, two nationally watched tragedies emerged from Modesto with the disappearances of Chandra Levy and Laci Peterson.
Now some supporting cast members from both dramas are appearing together in Modesto night spots.

Murder suspect Scott Peterson's lead attorney, Mark Geragos, won't say why he's been sharing drinks and cigars with Cadee Condit, daughter of former Rep. Gary Condit, other than that she's a client.

Thanks for the post.

Does't it sound just like Scott an admitted fan of the "Soprano's", to talk to underworld types to "steal" his vehicle or "kidnap",his wife. On the other hand it also sounds like a Geragos leak, tan van,neo-nazi's ummmmm any thoughts?

An elaborate ruse? Could be a con by Geragos using the age old "let the mark do all the work". MPD is back in the Bay and possibly spending alot of time this story. OTOH, verifying the people and vehicles, etc. should be easy if this is the real deal. Interesting to say the least. Or it could all be phony and this attorney is looking for his 15 minutes. Who knows anymore?

It's hard to know what to make of it. On one hand (if it's true) it helps the prosecution with their theory of premeditation. On the other hand, I agree, it connects with the "brown van" theory. Maybe SP claims that he hired someone to steal the SUV and they went too far. But then how would that "story" fit into the "satanic cult" theory? Oh dear, Geragos has me so confused I'm just not sure anymore that Scott really did it! ;)

Hey, Jack! Glad you heard from your son and thanks for letting us know. No storm damage here where I live. We were lucky! Thanks for asking.

I have a question for all about reported evidence that has been found and what has been reported by news. (1) They have found a root hair from Laci's head in a pair of needle-nosed pliers. (2) The consensus from defense and prosecution seems to be that there was no dismemberment--the sea did it. Question: The root hair in the pliers seems to suggest that Laci's head was lifted with the pliers. Why would SP or anyone try to pick up a 140+lb. whole body with a pair of pliers?

My guess is that he was using the pliers to secure the wrapping (I heard somewhere that chicken wire might have been used). While doing this he caught a hair in the pliers. Contrary to what some say, I think this is a significant piece of evidence. Of course, her hair (without a root) could have gotten in the boat innocently through indirect transfer. It's less likely though that a "pulled out" hair would be there.

I agree Jackie-O. I think the gag order is killing him. His inclination is to "razzle dazzle" potential jurors. The gag order really benefits the prosecution, I think, in the long run.

I'm still on the fence about dimemberment as opposed to decompostion..waiting to see if there is any evidence of tool marks.
But I have been thinking lately that this clear plastic that was found was placed under Laci during transportation to the bay to protect either the floor of the boat or the truck to prevent evidence transfer.

Well his razzle-dazzle seems to not have impressed most everyone here. Jurors, in the end are very smart people and it the evidence is there, and I believe it will be, no amount of MG's Hollywood style luster will help Snotty.
Reminds me of a crude saying...

I would be very suprised if there was dismemberment. He really didn't need to do it given his method of disposal. Also, it would have taken a great deal more time - actually doing it somewhere else, cleaning all the blood off him self, etc.

True, I think we all see through it. But there are plenty of folks out there who are, well, I hate to say it, but they are plain stupid and very impressionistic. I've said all along that jury selection here will be key and the defense will be spending a ton of money on consultants. To us, Geragos looks like a fool, but remember, he is trying to appeal to a different group. He'll be looking real hard for a certain type of person during jury selection.

ThanksI read the article earlier and was struck by the name of the gang, Nazi Lowriders...that sounds like a biker gang to me.

OK we've had questions about whether Scott was involved in some way with meth through his fertilizer sales, bikers run the meth connections usually.

Modesto is meth, biker country. But if Scott was selling the ingredients to the meth cookers he wouldn't need a stranger to hook him up with bad dudes.

Maybe that guy passed a polygrapgh because he does know Scott and the gang, but not the way he told the story about meeting Scott and hooking him up.

Does that make any sense?

I thought that tool marks had already been denied by both prosecution's experts and defense's experts.

this clear plastic

In addition to the clear plastic that was found more recently, back in Jan., when they first started searching, wasn't there a blue or black pool tarp found? Just wondering, if she was double wrapped.

I have a theory on how and why Peterson may have killed Laci and Connor. It's only a speculative theory, but think about this:

What if Laci and Scott had a horrible argument over his cheating and he hit her, hard, hard enough to cause her to go into labor? She starts yelling at him that she is going call the police and have him charged with assault and he goes nuts and hits her some more.

Hi Eva - I just don't think this was a crime of passion - there's too much evidence of premediation (the boat, Amber, the purchase/aquisition of materials, etc.). There's likely more evidence, in light of the charges and the fact that the DA is going for the DP. I don't think there was ever any evidence of domestic violence, was there? Usually, with the type of murder you describe, you find a history of domestic abuse. Just my opinion!

I know you're right, I just have trouble imagining anyone planning to murder their pregnant wife. I keep looking for explanations of how it could happen. I guess I am looking for a rational explanation for irrational behavior. But then, pre-meditiation is rational, just anti-social. I guess this guy is just evil.

I agree - it is easier to "wrap our minds around" a crime of passion in this case as opposed to premeditation. My best guess is that, bottom line, this guy wanted to get rid of this wife and soon-to-be-born son. Most people think that this is an unreasonable explanation because he could, obviously, divorce his wife. They aren't looking at it from the perspective of someone without a conscience, however. In his mind, he would not want to do that for two primary reasons: he would not want to "look bad" to others and he would not want the financial and psychological obligations for the rest of his life. I think he had an obsession with Amber. He seems to be an obsessive guy (for example, he went back to the bay instead of playing golf which blew his alibi and, apparently, he kept going back to the bay). I would like to know if his other affairs were obsessive. Oh well, I better get back to work. The above is simply my analysis from afar - I haven't met the guy and I don't want to!

Just thinking, mostly about the connections Scott could have made on his own if he was selling products to meth cookers.

As to the polygraph, I guess we'd have to be privy to all the questions he was asked while hooked up to know all the answers.

More leaks for us to ponder...
