Buying a $50 bogus green card and showing it to the recruiter happened BEFORE he was under the UCMJ; so you can't get him there.
The guy has been in this country since age 4: far below the age of consent, so legally, you can't charge him with illegal immigration.
About the only thing you COULD do is zap him for providing fraudulent documentation to a federal official, i.e. his recruiter. Problem is, WE DON'T HAVE ENOUGH RECRUITS NOW, thanks to our "friends" in the media and in the "public-education-complex". I can remember, even back in the late 1970's, when I was in high school, teachers and counselors showing their "disappointment" at my choosing the military for a career (at the time: I did ROTC and 6 years, and left the Air Force just ahead of the RIFs. . .)

He can STILL be nailed with it since he is NOW under UCMJ and comes under the same regulations that I did when I was in uniform.

What part of 'illegal' don't you people understand?
UCMJ is harsh, and people have been butt raped by it for far lesser crimes than Escalant is guilty of.
And he is given a pass on it.
There has been a breach of UCMJ, and it is ignored.
What part of that do you not understand?
