“Because what a raped woman thinks about bearing the child of her rapist matters.”
It does matter. It just doesn’t matter in regard to the rights of the child to live. To murder a baby is wrong. Always.
Oh yes it does matter specifically and precisely to the rights of the child to live.
I do not disagree that murdering a baby is wrong, but if the raped mother decides that she isn’t going to bear the child of her rapist, that is exactly what the result is going to be, and no one is going to be charged for it.
I do not see any way at all that is going to be changed outside of convincing the mother to not do it.
That is the only practical way to arrive at the solution that you seek, because forcing them to bear the children of their rapists is not going to happen as a matter of law.
Since all of this discussion is entirely theoretical, let me ask you and others a practical question.
Suppose that, in an imaginary future, you knew for certain that the Supreme Court of the day would declare a Federal statute constitutional banning all abortions beyond 12 weeks, except for pregnancies resulting from rape and incest.
Further suppose you were a congressman or U.S. Senator.
Would you vote for the law?
