The terrorist who murdered the late Ori Ansbacher will also be charged with rape on nationalist grounds. In recent years, several acts of rape and sexual assault have been committed "as part of the Palestinian national struggle," as the terrorists have defined it. However, the defense establishment makes it difficult to recognize rape as a nationalist offense, leading to the recognition of its victims as victims of hostilities that are eligible for compensation. But recently there has been a change in the matter: in a series of petitions, the courts have rejected the position of the Ministry of Defense, and ordered it to approve this recognition. This happened as a result of a stubborn struggle by some of the injured families, some of whom conducted an independent investigation to find out the background in fact - in the absence of such an investigation by the police and the GSS.

On Independence Day 2006, nine-year-old Lipaz Chimi left her home in Beit Shemesh for celebrations in the city center. That same year, this time in Jerusalem, a 13-year-old girl was standing at a bus stop at the Pisgat Ze'ev junction in Jerusalem. Four Palestinian boys from the Anata and Shuafat refugee camps emerged from behind her and pushed her down a slope on the side of the road. On the hidden slope, they beat her and raped her violently, chanting "stinking [sic] Jew" and "settler." At one point she managed to escape. Her story provoked a great public outcry, after during the trial she was asked to demonstrate to the judges how she was raped. In this case, too, the Ministry of Defense initially refused to recognize her as a victim of terrorism, as in their opinion there was no evidence that the rape was carried out for nationalist motives.

Short explanation before we continue: A hostile act is defined in the law as "harm from an act of violence whose main purpose is to harm a person due to his belonging to a national-ethnic origin, provided that it stems from the Israeli-Arab conflict." According to the law, recognition of a victim of hostilities will be accepted "in circumstances where there is a reasonable basis to believe that it is a hostile hit." Proving the national motive is not always a simple matter, and it requires significant evidence. Of course, not every sexual offense of an Arab man against a Jewish woman necessarily stems from a nationalist background, and not in any case will this question be examined at all. However, there are cases where the nationalist motive is so obvious that it is difficult to ignore it.

"In general, the Ministry of Defense refused to recognize sexual offenses as a terrorist incident under the Compensation for Victims of Hostilities Law," explains Adv. Quite a few sexual assaults on a nationalist background, and I asked for a position of principle from the Ministry of Defense on the issue. He replied in writing that there was no impediment to the Ministry of Defense recognizing a sexual assault as a terrorist incident, provided that the victim presented evidence of a nationalist motive. I had to go through Palestinian media, articles on Palestinian websites and textbooks of the PA myself, and I proved that there is a wild incitement, encouraged by the PA or its closing its eyes, to see Israel's actions as a 'rape' of the Palestinian people. Aqsa is described as a woman being raped by an IDF soldier, or the land of 'Palestine' in the form of a woman whose IDF soldier takes off her pants a moment before she is raped. In 2008, a 25-year-old student from Bezalel made her way to the Guy Ben-Hinnom area of ​​Jerusalem. She worked as a tour guide, and asked to take a preliminary tour. The Ministry of Defense initially refused to recognize the attack as having a nationalist background, but after almost a decade of struggle, in 2017, it withdrew it and recognized it as a victim of hostilities. This also happened thanks to the opinion of the former head of the Investigations and Intelligence Division, retired Manny Yitzhaki, who stated that "the victim was attacked because she was Jewish, and therefore this is an event whose background is nationalistic."
