Leaving your spouse to engage in deviant acts with members of your own sex is hardly acceptable conduct; and should certainly have similar negative consequences, to those which the law imposes for adultery.

Marriage is a contract. The law has always had a role in enforcing contracts and determining claims involving breach of contract. I will toss the question back at you. Why should the marital contract deserve less protection than any other contract?

Yes indeed, but how & why is a sexual breach to be enforced by divisions of property? Who gave the state the power to assign sexual fault?

I will toss the question back at you. Why should the marital contract deserve less protection than any other contract?

It benefits all parties to settle such contracts peacebly without finding fault. No fault divorce works.

Keeping government out of our bedrooms also works.

Don't know where you've been but it happens ALL the time. It DOES influence property settlement. It certainly has a HUGE impact when kids are involved.

Oh, I know ... we can't, er shouldn't legislate morality, right? LOL! It's LEGISLATED ALL THE TIME! It's just that giving a green light for deviancy sickens normal people. BTW, are you normal?

I wonder what flavor? Grape has always been my personal favorite.

Realize that this is no victory for the Homosexual Community. The basic theory by homosexuals is that gay martriage = Heterosexual Marriage. DOMA is false because gender has no meaning.

The SC has said that homosexual behavior is not sexual behavior. That there *is* a qualitative difference between a union of a man and a woman and two members of the same sex.
