I think the federal courts have banned use of infrared sensors by the cops to detect pot growing in homes, so cigarettes might be safe. (However, when you buy them they could follow you home and say its prima-facie evidence of intent to commit a crime!)

Of course, to the authoritarian zealots that's the next "logical" step. It is already being floated by the EPA's announcement last week, and The People's Republik of Kalifornia is working diligently on it. (Also in cars.)
