On Thursday, February 7, the Senate Judiciary Committee held its second hearing on the nomination of Judge Charles M. Pickering, Jr. to the Fifth Circuit Court of Appeals. At the first hearing on October 18, 2001, Judge Pickering's answers did not shed sufficient light on his position on reproductive choice. At yesterday's hearing, Judge Pickering's testimony failed to assure the American public that he will safeguard the rights to privacy and reproductive choice.
Judge Pickering's record reveals deep-rooted opposition to reproductive rights and hostility toward other civil rights. Judge Pickering poses a clear and present danger to all people's participation in the economic, social and political life of our nation. President Bush's judicial nominees should all come with a warning label: 'Beware...May Be Hazardous to Women's Health and Civil Rights.' Judge Pickering is no exception.
Because the overwhelming majority of cases are decided by the lower federal courts, it will be the judges on those courts--like Judge Pickering--who determine the future of the federal courts and their role in protecting individual rights, including privacy and reproductive freedom.

I am writing to you to oppose the nomination of Mississippi federal district court judge Charles M. Pickering, Sr. to the United States Court of Appeals for the Fifth Circuit.
Throughout his career, Judge Pickering has demonstrated hostility towards reproductive rights:
-In 1984, when Judge Pickering was the president of the Mississippi Baptist Convention, he presided over a meeting where the Convention adopted a resolution calling for legislation to outlaw abortion except when necessary to preserve a woman's life.
-In 1979, as Mississippi state senator, Judge Pickering voted for a resolution calling for a constitutional convention to propose an amendment that would have banned abortion.
-In 1976, Judge Pickering chaired the subcommittee of the Republican Party's Platform Committee that adopted a plank calling for a constitutional amendment that would have overruled Roe v. Wade. Judge Pickering spoke in support of that plank on the floor of the Republican convention that year.
Because the overwhelming majority of cases are decided by the lower federal courts, I am concerned that judges appointed to these courts be committed to safeguarding the rights to privacy and reproductive choice as set forth in Roe v. Wade and the earlier Supreme Court decisions upon which Roe rests. At his hearings before the Judiciary Committee, Judge Pickering failed to assure the American public that he supports Roe v. Wade and that he will fully protect a woman's right to choose.
I implore you not to confirm Judge Pickering. His record reveals deep-rooted opposition to reproductive rights and hostility toward other civil rights, and he has failed to assure the American people that he will protect their basic freedoms. Judge Pickering poses a clear and present danger to all people's participation in the economic, social and political life of our nation.

But it was a tough road to travel for anyone. With Ashcroft being a God fearing man, I don't believe it was in his nature to take on a grieving widow, immediately following her husbands death. Now, that may be considered bad politics, but it was the right thing to do at the time.
Ashcroft is too meek in dealing with liberals.
There's a bigger problem that most conservatives and republicans have when dealing with liberals. It's always been easier to be for something, then against it. In other words, its easier to say yes, then to say no. No is equated to losing something, while yes is equivalant to retaining it. Human beings generally have a positive inpression of the word yes and a negative impression of the word no. Liberals love the yes word and conservatives have a tough time convincing people that theres an upside to the word no.
Making the "gimme gimme gimme-I wan it, I wan it, I wan it" mentality of the last 35 years real difficult to turn around.

Retaking the Senate and its procedural processes is a must. Otherwise, Bush won't get anything done the rest of the term, including banning partial birth abortion. Daschle just prevents everything from coming to a vote.
Retaking the Senate is far from assured, in large part because lots of Christian conservatives don't vote because they think the Republicans aren't conservative enough. So in essence, Christian conservatives prevent judges like Pickering from being seated.

I am appalled that a federaly funded entity like Planned Parenthood is using its federal money to smear and falsely vilify a courageous judge like Pickering.
I remember Pickering standing up against constant death threats from the KKK of Byrd and Hollings. God, I hate the DNC and its fascist shock troops.
Could you imagine Clinton and a Democrat controlled House allowing a single penny to go to an organization that maintaned an anti-Clinton website. It is time for Republicans to wake up and kick their wealthy enemies off of welfare. DEFUND THE LEFT!
