'....The Internal Revenue Service has strict rules against disclosing taxpayer information. The IRS and Justice Department contend that in this case the practice was permissible but a "misstep" and are looking at procedures to prevent a repeat.

The case involves a government challenge to a tax shelter promoted by KPMG LLP, the accounting firm that gave advice to Mr. Simon and scores of other taxpayers. The campaign of Democratic Gov. Gray Davis has seized on the disclosure to attack the Republican in what is shaping up in the polls as a close election.

Justice lawyers included the company's confidential client log in an administrative summons July 9 demanding the production of tax-shelter information.

A Landmark Foundation press release suggested yesterday that the lawyers' action was politically motivated. It said the lead Justice lawyer in the case, Stuart D. Gibson, is a "Democratic Party activist in Virginia."

A Justice Department spokesman and Mr. Gibson did not return calls yesterday seeking comment. Mr. Gibson is chairman of the Fairfax County School Board, and his candidacy was endorsed by the local Democratic Party.

Mark R. Levin, Landmark's president, said that identifying taxpayers in a lawsuit against a company "was not only gratuitous, but likely illegal."

"The government is not free to release the names of taxpayers except in extraordinary circumstances, and those circumstances did not exist in this case," said Mr. Levin, a Justice Department official in the Reagan administration.
....."There is a serious question whether the Internal Revenue code and Justice guidelines were violated by the public disclosure of these taxpayers' names," he said. "It is especially troubling that this conduct has influenced the gubernatorial race in California, which raises the specter of partisan politics. This is as close to the politicization of the IRS as anything I've ever seen."

Then is not there the case to throw the case out , for it to be dismissed out right ?

1)First based on the fact that what the Justice De(spot)- department lawyer did was illegal ,

2) the fact that the accounting firm GAVE the taxshelter to Simon as ADVICE , and that

3 ) Simon , apparently is shown by the latter circumstances to have done nothing willfully wrong ?

Simon is no diferent from Riordan : Republican in name only .

Today the Orange County Register ( a mostly cconservative newspaper Southern Calif. revealed Simon is for gay rights. I haave the paper with me now . Heading 'CALIFORNIA - Bad news for GOP gubernatorial candidate Bill Simon , right : He dropped further in the polls and his backing of gay rights has losst him support in his own party .'

Riordan is no different from Simon.Simon is no different than Riordan . I live in Orange County Calif.

A short time after Riordan was elected Mayor of Los Angeles , he rode in a car in the Hollywood gay pride parade. I saw the LA Times article myself the next day.

Dear oc-flyfish , it was nice talking with you when I called your office. The following is my response to # 4 to Bill Simon in the Log Cabin survey of questions to him 'Would you back a State Party Charter for the Log Cabin Republican Party of California ? ' .

When I saw that club's table at the GOP state convention in Anaheim Calif . in 1999 .I was utterly disgusted and sad .It is an outrage and sad that even the Republican Party would cave to this by allowing them even a voice and a table.

Radio talk hosst Michael Medved is right : Politicians should be NUETRAL on the issue of the agenda of homosexuality / activists .They should neither promote in nor condemn them in the political arena . I was very sad and disappointed when I read in the paper during thw 200O ' primary campaign that Bush met with the Orange County California 'Republican' Log Cabin Club .I knew that Bush would probably win the Presidency , but I left my ballot blank ( I , as a Republican , did not vote for President in 2002'- I have NEVER done that before , ever - ) in protest of G.W. Bush having allowed an openly homosexual Congressman give a speech at the Republican convention( three cowboys from Texas protested in their seats by holding their hats over theor hearts in prayer ) , and the fact that then candidate G.W. Bush met with the homosexual Republican Log Cabin Club in Orange County Calif . I live in Orange County.

There was a homosexual where I worked .He was friendly to me , and I reached out to him . Knowing he was a homosexual , I even erased some derogatoty graffiti someone had written in the bathroom about his homosexuality .I really felt bad for Bill . I loved that person as a human being .He came out of the closet at work ,as did another person who I had known for seven years at work .This latter person I am talking aabout worked there for seven years , and we always pal 'ed around , until 1994 when Governor Wilson caved to the liberals and signed the 1994 law forcing Busniesses to hire Homosexuals . I was very sad when I found out Jeff was homosexual : he alsso ' came out ' at work shortly aafter Wilson signed thaat 1994 law . Jeff had worked there SEVEN YEARS before coming out . Can you imagine the shock and disappointment I felt , and how uncomftorable ? I am a practiicing Christian , and I know to love my fellow man , even homosexuals . But to force the homosexual agenda in our face as the liberals do , and for Republicans to cave and coddle their agenda in the schools and the political arena is WRONG . The scriptures specifically say so , and the scriptures say SHAME on those who heartily agree with them and approve of it .

SIMON IS WRONG MA'M . Sadly . I believe he now has no chance of winning in November 2002'.
