Caller's office received a public records request in Rush Limbaugh case. File includes letters from atty in SAO to Roy Black, defense counsel. Checked with AG's office and AG says the files are public records except there are two letters which include plea negotiations which are not normally to be revealed so may or may not be public record.

...

All info in file is confidential as to his client, the state, under 4-1.6.

"The only "charges" are rumors being spread in the media."

You forgot to add the handful of Rush haters on FR ~ what a miserable little group of whining misfits. :)

Private medical records aside, I don't see how Rush can squirm out of these charges.

That is one of the points my friend. Rush has not been charged with anything.

You're a radio guy. You know what signal to noise ratio is. You know that the discriminator circuitry is different for channels with high Q than low Q.

Understand ... the Enquirer is read by people who understand what the usual signal to noise ratio is in it. And so is the New York Times. One low Q the other high Q. The readership's discriminator functions have been established.

Now. If a person wants to get a false signal through, which is the better channel?

You guys are letting Rush off easy. What has this rich man done for you? I will bet you that years ago he wanted to prosecute senior citizens who went to Mexico for cheaper prescription meds! I should research that one.

I found it interesting that they gave immunity to the two who were actually blackmailing Rush. That about says it all to me regarding their motives.

but IF they are 'public documents', then public access laws trump confidentiality,--

DAMN, if it applies to Rush's personal medical records why couldn't we get a glimpse of Clinton's medical records.

When my wife had surgery last year, they put her on a morphine drip with the button to self-medicate. She had me go home while her sister stayed with her the third evening. I was on my way there when she called me the next morning. Bright, cheerful and happy. Ready to face the day. She wanted to see our boys and told me that when I got up there to the hospital, that once I helped her get a bath and do her hair and all, that she wanted me to have my parents bring the boys up to the hospital.

When I got there, the nurse told me that she was going to be coming off her morphine. I was happy. About 15 minutes later, I was getting concerned because she was very sluggish and non-responsive. Finally, she passed out. I demanded that the nurse come down immediately, but it was nearly an hour and a half. The nurse had put her on what is known as a "Bolos Dose" which is a post-load dose that's about 3-12 times higher than normal to allow the person to have some in their system for a while as they wean down. The nurse walked out of the room for nearly 20 minutes and had not told my wife that she had switched the machine.

My wife self-medicated three times on what we later found out was nearly 10 times the normal dose. She passed out and was out for nearly 10 hours. Of course, she didn't get to see the boys that day. There were, fortunately, no after effects. She wore it off well. But, the nurse was fired. And she should have been. Had my wife been conscious enough to hit that button one more time, she may have not made it through it, or been permanently harmed. My wife was on the maximum dose allowed at the time.

Really? I see a looming 42 USC 1983 suit against the prosecuting attorney's office, with a bucket of money at the end of it.

Rush should win and then do the liberal thing, give it to the chill-rund (as he says)!!!

Astonishingly, the patients did a better job of maintaining a certain level of medication.

I believe it. After my last C_section a year ago, the nurses would come in and say "It's been 12 hours since your last pain medication! Don't you want another shot??" almost panicking. Hey -- I was the patient. If I didn't feel enough pain to need medication, I didn't want to take any!

Matthew Perry is the better example. I believe most celebrities who come forward with addictions are "caught" in possession or breaking other laws, like driving under the influence. Matthew Perry self-reported his abuse and recovery (-ies?) and was never caught by the police for anything. That is Rush's situation.

"but there are places all over America where it happens all the time"

Really? You can name cases where prosecuters spent the public's money going after a former user after they went through treatment and are now clean??? Please list one of these that is happening all the time. The fact is, is has never happened....

What did Rush open his program with? I turned on the radio a mite late and heard him say that because he loves us most of all, he will tell us the truth, some time later as the program unfolds. What was he talking about?

There realy is nothing to squirm out of. Even if charged as a user, Rush would automatically qualify for the drug treatmen based drug court. End result, treadment complete case dropped.

However, they had to catch rush red handed.
