Man Found Guilty Of Sexually Assaulting Infant Defense Stressed Lack Of Evidence
OSHKOSH, Wis. -- A jury in Oshkosh found a man guilty in the sexual assault of a 7-month-old girl.
The jury in Winnebago County Circuit Court deliberated more than eight hours before convicting Michael McCabe, 40, of Neenah of first-degree sexual assault.
McCabe was charged in August 2003 after the child's mother said she noticed blood in the child's diaper and brought the baby in for examination. Authorities say a doctor found injuries in the child's genital area that weren't believed to be accidental.
According to testimony, the woman earlier had heard the child scream while in the care of McCabe.
Defense lawyer Mark Fremgen stressed there was a lack of evidence to link McCabe to the crime.
McCabe also went on trial last March, but it ended in a mistrial when the jury deadlocked.
McCabe took the witness stand in his own defense. He faces up to 60 years in prison when sentenced Dec. 16.
