CINCINNATI - A federal appeals court on Saturday reversed a lower court's ruling that Ohio voters could cast provisional ballots on Election Day anywhere in the county in which they are registered.
The 6th U.S. Circuit Court of Appeals ruled that a provisional ballot cast outside a voter's home precinct isn't valid, agreeing with Ohio Secretary of State Kenneth Blackwell. Federal law allows people to get provisional ballots if they are in the right jurisdiction. Blackwell, a Republican, defines that as a precinct, while Democrats say it's the voter's county.

>>YES!!!!! GO BLACKWELL!!!!<<
I would move back to Ohio to vote Blackwell to replace Taft the RINO.
DU is gonna get their panties in a wad over this one. Of course the only reason to vote at another precint is to cheat.
PEOPLE, THIS IS BIG.
It is entirely conceivable a fraudulent activist could drive from precinct to precinct, naming him or herself a name from a list, and voting multiple times. But if that person keeps coming back before the same voting judge, they will be recognized and the police called.
This stops that. This forces any such fraud to not just have a name, but to know what precinct to go to. But then again, that person simply cannot come back to the same precinct more than once.
Poll watchers. USE DIGICAMS. This will also evoke fear of being discovered returning to the same precinct.
PRAISE THE LORD
Don't tell me....A judge who has read the U.S. Constitution!
Amazing when you're used to the 9th Circuit Court!
Hopefully he'll be our next Governor!
But. . .but. . . this could disenfranchise thousands of voters. Isn't it a little much to ask people to vote in their own precinct?
YESSS!!!!!!
This will cause havoc and only for the rats! Cuz they are the one's who wanted to cheat.
WOOOOOOOOOO HOOOOOOOOOOOOOOOOO!
We were just discussing this at a campaign meeting tonight. Hopfeully this will be the final word on this BS.
I often wonder why some laws are vague enough for creative judges to drive an aircraft carrier too. I am increasingly convinced that judges are not the sharpest tools in the drawer.
OK so maybe "only" 99% of us deal with precincts; why couldn't the law say "'precinct', or alternative jurisdiction"?
As a Columbus Ohio resident, all I can say is,
WOOOOOO HOOOOOO!!!!!!!!!!!!!!!!!!!!!
mmmmmmmmm, Rulings
Why not....stuffy rules should not prohibit the free expression of my multiple personalities voting where ever the urge hits!
Welcome to Free Republic!
They overruled a lower federal court (which had a Clinton appointee BTW). This matches the rulings made in other federal appeals courts, so yes I think there are now two precedents for it. This is a big win for State election laws. The new Federal voting laws of 2002 in response to Florida have proven to be bad IMHO because they've opened up a pandoras box of potential election fraud, just like McCain-Feingold is being exploited. We are much better off with the Federal government (Congress) getting the **** out of the States business and out of the way of political free speech.
N.E. Ohio Pings!
The next Governor of Ohio!
What's this ???
A Judge that believes in the law and doesn't make it up on his own ???
Hint: read the last line.
Hoorah! I'll vote for Blackwell too. Get him nominated!
