Ohio Provisional Ballot Ruling Reversed

CINCINNATI - A federal appeals court on Saturday reversed a lower court's ruling that Ohio voters could cast provisional ballots on Election Day anywhere in the county in which they are registered.

The 6th U.S. Circuit Court of Appeals ruled that a provisional ballot cast outside a voter's home precinct isn't valid, agreeing with Ohio Secretary of State Kenneth Blackwell. Federal law allows people to get provisional ballots if they are in the right jurisdiction. Blackwell, a Republican, defines that as a precinct, while Democrats say it's the voter's county.

Yes indeed. This is the ruling that really had me worried. This is a great relief and answer to prayers.

Just picked this paragraph off the AP story:

The ruling by the 6th U.S. Circuit Court of Appeals supports an order issued by Ohio Secretary of State Kenneth Blackwell. Democrats had contended the Republican official's rules were too restrictive and intended to suppress the vote.

Republican official's rules??? How about the STATE LAW!

What a joke. Soon it will be OK for me living here in Oklahoma to cast ballots in Kansas elections.

You'd have more of an impact if you voted in Missouri.

The dems have been plotting this for four years, the have figured every way to cheat there is. I won't be surprised if Kerry wins.

It's not as if Republicans have been sitting on their butts for four years. Republicans are ready to counter the DemocRATS lawless attacks.

He felt ENTITLED to vote both places since he owns property in both.

Actually, he is entitled since he pays taxes in two states, he should be able to vote for both states elections, except not Federal (President/VP).

Hope to God this stands! Provisional voting strikes me as one of the WORST ideas I've heard in a long time.

I don't believe people voting in two States is a huge problem. It's just not worth the price of the solution which would entail a Federal voter registration database.

We don't need a federal database. The various states can check their lists against each other.

I think your list is too short. Why should he get to vote for senators and congressmen from more than one state?

I look for big things from Blackwell.. Next Governor.. possibly.. He is undeniably one of the Rep's brightest stars. I could easily imagine him as a two year Governor spending alot of time.. making Hillary's life miserable.

Provisional votes and the Campaign Finance reform ! I think after this election if should become national law to require picture ID at time of voting! To heck with "racist" attacks from the left.

And I am sick of the "pc" stuff when it comes to profiling, if you look like the perpetrator of a crime- I don't care what minority group you belong too - just live with it.

I heard that the Dems have brought as many as 35 different cases and 22 or so have already been thrown out: 23 now? The Dems have no moral fiber. They want to win and it doesn't matter how.

The Ohio Democratic Party and a coalition of labor and voter rights groups argue that Blackwell's order discriminated against the poor and minorities, who tend to move more frequently. (http://apnews.myway.com/article/20041024/D85TFEK80.html)

What a crock. I don't give a flip if they move 365 times a year, they had better make sure they are registered to vote in the place they'll be living. This is a ruse and we all know it. They want those sorry crackheads voting in every precinct they can be bused to.

When Kerry talks about a million disenfranchised voters in Florida [I believe that is the number now], he must be talking about the million or so double or triple votes that weren't allowed.

Hey Kerry, you are a real so and so.

Next one should be a judge ruling that Tom Daschle doesn't legally live in S. Dakota so he can't be Senator! Yahooty!
